ORDINANCE NO. <br />AN ORDINANCE ESTABLISHING THE SUFFICIENCY OF THE EUGENE <br />URBAN GROWTH BOUNDARY FOR PURPOSES OF RESIDENTIAL LAND <br />NEEDS BY MAKING A TYPE I TEXT AMENDMENT TO THE EUGENE- <br />SPRINGFIELD METROPOLITAN AREA GENERAL PLAN; AMENDING TEXT <br />AND ADOPTING AN APPENDIX TO THE ENVISION EUGENE <br />COMPREHENSIVE PLAN; AND AMENDING SECTIONS 9.2750 AND 9.2751 <br />OF THE EUGENE CODE, 1971. <br />The City Council of the City of Eugene finds as follows: <br />A. Historically, the City of Eugene and the City of Springfield had a shared urban <br />growth boundary ("Metropolitan UGB") within which Eugene's jurisdictional area of responsibility <br />was the land on the west side of Interstate 5 and Springfield's jurisdictional area of responsibility <br />was the land on the east side of Interstate 5. <br />B. House Bill 3337, passed by the Oregon State Legislature in 2007 and codified at <br />ORS 197.304, provides: "Notwithstanding an intergovernmental agreement . . . or <br />acknowledged comprehensive plan provisions to the contrary, a city within Lane County that <br />has a population of 50,000 or more within its boundaries shall, separately from any other city: <br />(a) Establish an urban growth boundary, consistent with the jurisdictional area of responsibility <br />specified in the acknowledged comprehensive plan; and (b) Demonstrate, as required by ORS <br />197.296, that its comprehensive plan provides sufficient buildable lands within an urban growth <br />boundary established pursuant to statewide planning goals to accommodate estimated housing <br />needs for 20 years." <br />C. Consistent with ORS 197.304, in 2011 the City of Springfield and Lane County took <br />actions that established the Springfield UGB by adopting a division of the Metropolitan UGB <br />along Interstate 5, with the land east of Interstate 5 thereafter included in the "Springfield UGB" <br />and the remainder land on the west of Interstate 5 to be included in an urban growth boundary <br />for Eugene. <br />D. Past studies pertaining to the residential land supply within the, now obsolete, <br />Metropolitan UGB (i.e. the 1999 Supply and Demand Technical Analysis and the 1999 Site <br />Inventory Document) are no longer applicable and new studies pertaining to the Eugene UGB <br />are required by ORS 197.304. <br />E. This Ordinance addressing residential land is part of a legislative review of the <br />Eugene UGB that has already addressed employment, park and school land. <br />F. Through this Ordinance, the City of Eugene demonstrates that the Eugene UGB <br />provides sufficient buildable lands to meet Eugene's residential land needs for the 20-year <br />planning period (2012-2032), based on the population forecast adopted in 2009. <br />NOW THEREFORE, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Ordinance - Page 1 of 4 {00175543;13 } <br />January 2017 DRAFT <br />
