The record was left open until June 15, 2016 for the <br />submission of new evidence, until June 22, 2016 to respond to any new evidence, and <br />until June 29, 2016 for the applicant's final legal argument. The applicant and opponent <br />Valley River Inn submitted materials during this period. One of the applicant's submission <br />was received by e-mail at 5:01 p.m. on June 15, 2016. Valley River Inn objects that the <br />applicant's submission was due by 5:00 p.m. and therefore was late and should be <br />rejected. I do not see that the one minute makes any difference, and the record is being <br />further extended by this letter. Therefore, all of the materials submitted to date are <br />accepted. <br />On July 6, 2016, Valley River Inn submitted a letter objecting to the applicant's final legal <br />argument on the ground that the final legal argument improperly contained additional <br />evidence as well as requests for additional adjustments. Valley River Inn is correct that <br />the applicant's final legal argument exceeded the scope of final legal argument. The <br />applicant suggested allowing Valley River Inn additional time to review the additional <br />information in its final legal argument and extending the open record period accordingly. <br />Valley River Inn agreed to the applicant's suggestion. <br />Therefore, the record is extended seven days from the date of this letter until July 21, 2016 <br />for Valley River Inn to respond to the applicant's final legal argument.
