FINAL ORDER OF THE EUGENE PLANNING OM':_' `'CA <br />ON APPEAL OF HEARINGS OFFICIAL DECISION' LAUREL RIDGE W E <br />L BACKGROUND <br />The subject zone change application, Laurel Ridge Zone Change (Z 15-5), was initially forced complete by <br />the applicant on July 2nd, 2015. A public hearing before the Hearings Official was held on August 26, <br />2015. Following the public hearing, the Hearings Official granted a request to leave the public record <br />open for twenty-one days for additional public testimony, with the applicant's final rebuttal period <br />ending on September 16, 2015. On September 24, 2015, the Hearings Official issued his decision, finding <br />that the zone change was consistent with all the applicable approval criteria, including consistency with <br />the Metro Plan. On October 6, 2015, Weitzin B. 6lix on behalf of the Laurel Hill Valley Citizens <br />neighborhood group, filed an appeal that included four assignments of error. <br />The Eugene Planning. Commission held a public hearing on this appeal on October 20, 2015, and began <br />deliberations the same evening. The Planning Commission continued deliberations on October 26, 2015, <br />with action taken to adopt a Final Order affirming the Hearings Official's decision to conditionally <br />approve the subject zone change application. The Final Order of the Eugene Planning Commission <br />regarding this appeal is based on the record, and limited to the issues raised in the record that are set <br />out in appellants' written appeal statement, in accordance with applicable procedural requirements of <br />the Eugene Code (EQ. <br />II. FINAL ORDER <br />The Eugene Planning Commission has reviewed the record and the appellants' assignments of error, <br />and has voted to affirm the decision of the Hearings Official to conditionally approve the Laurel Ridge <br />Zone Change (Z 15-5). The Planning Commission hereby incorporates the Decision of the Hearings <br />Official, dated September 24, 2015, by reference (attached as Exhibit A). The Planning Commission <br />further concludes that the Hearings Official's decision correctly determined the subject zone change <br />application to be in compliance with each of the applicable approval criteria at EC 9.8865, with <br />sufficient findings provided as a basis for approval.
