HomeMy WebLinkAboutHearing Notice (Planning Commission 7-14-2015)1:.., 11 1 'inning Commission NOTICE OF PUBLIC HEARING Tuesday, July 14, 2015, 6:00 p.m. Harris Hall, Lane County Public Service Building 125 East 8th Avenue Eugene, OR 97401 The Eugene Planning Commission will hold a public hearing at the above noted time and place to consider the following: File Name(#): Rest Haven Memorial Park (MA 15-1 and Z 15-1) Request: Metro Plan Amendment to change the land use designation from Parks and Open Space to Low Density Residential for the approximately 79 acre property; and Zone Change from PL Public Land to R-1 Low Density Residential for the northern approximately 28 acres in cemetery use (resulting in the entire property being designated Low Density Residential and zoned R-1 Low Density Residential). Location: 3900 Willamette Street, Rest Haven Memorial Park Property Owner: Charles Wiper, Rest Haven Memorial Assoc. Representative: Carol Schirmer, Schirmer Satre Group Applicable Criteria: In making a recommendation on this request to City Council, the Planning Commission will address the relevant approval criteria from the Eugene Code (EC) at EC 93735 and 9.8865. The request will be also heard by the City Council in a separate public hearing, following action (a recommendation) by the Planning Commission. Testimony and evidence of those testifying should be directed toward the applicable criteria of the Eugene Code as listed above, or other criteria in the plans or land use regulations that the person testifying believes to apply to the decision. How to Submit Testimony: 1. Send a written statement to the Planning Commission, c/o Heather O'Donnell, Planning Division, 99 West 10th Avenue, Eugene, Oregon 97401 or by e-mail heather.m.odonnell@ci.eugene.or.us. To be included in the Planning Commission's packet, your statement must be received by the Planning Division by 5pm on July 6, 2015. 2. Submit a written statement after July 6, 2015 but before the public hearing closes. The Planning Commission will have less of an opportunity to read the written material prior to taking action on the request and forwarding their recommendation to the City Council. 3. Attend the public hearing on July 14, 2015 and state your concerns. Your spoken testimony will be recorded. The Planning Commission may limit the time for each speaker to a few minutes. You are encouraged to submit written testimony if you have detailed comments you wish to make. You may also state your opinion to your neighborhood group. To contact the neighborhood group, call the Neighborhood Liaison Office at 682-6243 or visit the website at: www.eugene-or.gov/neighborhoods All testimony received by the Planning Division will also be forwarded to the City Council; Council will hold a subsequent public hearing following the Planning Commission's recommendation, before any final action is taken on the request. Issues which may provide the basis for an appeal to the Oregon Land Use Board of Appeals must be raised by the person testifying not later than the close of the record at or following the final evidentiary hearing on the proposal. Such issues shall be raised and accompanied by statements or evidence sufficient to afford the Planning Commissioners, elected officials and parties involved an adequate opportunity to respond to each issue. Failure to raise an issue with sufficient specificity to afford the decision-maker and the parties involved an opportunity to respond precludes appeal to the Oregon Land Use Board of Appeals (LUBA). All decisions of the elected officials are final. A party may appeal the decision to LUBA within 21 days of the decision of the elected officials. Appeals to LUBA are governed by ORS 197.830 to 197.845. At the public hearing, testimony will first be accepted from the applicant and those in support of the request, then from those that are neutral, then from those in opposition. The applicant will also be given an opportunity for final rebuttal. Following the public hearing, the Planning Commission chair will announce whether the record is closed, held open for a specified period, or continued to a specific time and place. If a participant requests an additional opportunity to submit testimony, the City will accommodate that request by holding the record open for more written testimony or continuing the hearing on another date. The City of Eugene complies with state and federal laws and regulations relating to discrimination, including the Americans with Disabilities Act of 1990 (ADA).
