AT&T will submit its final packet of materials on March 27, 2015 and staff will have until April 3, 2015 to review those materials and confer with us on readiness for hearing. Under Oregon law, the total of extensions cannot exceed 245 days. By my calculations, AT&T has used 158 of its 245 possible extension days, which means the matter must reach final decision, including appeals, no later than January 4, 2016. In this case, the statutory 120- day rule and local code timelines have been extended cooperatively or quite some time, since late October, to allow the preparation of responsive materials for a complete application. Yet again, the applicant has requested another week, which is fine, but assuming the application materials come in next Friday, the 120-day clock would start immediately without an opportunity for staff to review the revised/additional materials. Our hope is that the applicant in this case would understand that it’s appropriate to allow for a reasonable period of time following the submittal for staff to look over the materials before we proceed with setting a hearing date, notice and formal evaluation and recommendation.
