Invitation to Neighborhood/Applicant Meeting
You are invited to attend a meeting to discuss a proposed project located at Calvary
Chapel of Eugene, at 4060 W. Amazon Drive, Eugene, OR, within the boundary of the SE
Neighbors Neighborhood Association.
The proposal is for the installation of a new wireless facility, in order to bring 4G service
to this area of Eugene. This project will improve connectivity for voice, data, and text,
ensuring a stronger and more reliable network in the area. The proposed facility is
landscaping and tree cover in the area. The ground equipment enclosure is proposed to
appear as part of the existing church structure.
As the consultants preparing this proposal, Lexcom Development invites you to attend a
meeting with us to review the proposed site plans, share information, and identify
design concerns regarding the proposal. A reduced copy of the preliminary site plan is
included on the reverse side of this page to identify the location and parameters of the
project.

Neighborhood/Applicant Meeting Notes

Project Description:
AT&T is proposing to install a new wireless facility in the City of Eugene. The proposal consists
of installing a 75-foot monopole designed to look like an evergreen tree (‘monopine’). The
ancillary ground equipment will be installed within a proposed equipment room designed to be
compatible in appearance with the existing on-site structures.
Meeting Summary
AT&T representatives from both Lexcom Corporation and from the engineering company,
Hatfield & Dawson along with representatives of the underlying property owner held a
neighborhood meeting on January 30 th at 4060 West Amazon Road. The doors opened at 6 pm
and the Town Hall style meeting began at 6:30 pm with opening remarks from the property
owner, followed by a summary of the above proposal by AT&T representatives. The neighbors
had an opportunity to speak, followed by a brief response from the representatives of this
proposal. A total of 14 people chose to speak and/or ask questions. Responseto the proposal
varied:
Seven individuals in opposition to the facility voiced specific concerns regarding the following
topics:
Health & safety: Non-ionizing radiation and cumulative effects of RF emissions on
humans,
Environmental safety to local wildlife (birds and bees),
Improper siting in a residential neighborhood,
Impact of the proposal on the beauty of the Amazon corridor,
Federal Government oversight not restrictive enough to ensure human safety.
Six individuals spoke in support of the facility voicing the following topics:
Competition for local provider keeping costs lower for most users,
Better coverage in an area that has been consistently poor,
Reduces the proliferation of towers in the area as other carriers can locate on site,
Voiced approval of the monopine design as it better suited the area,
Better communication options for both individuals and businesses,
Affordable internet alternative to local cable companies,
Better coverage for emergency situations.
One individual representing the neighborhood association also spoke, neither for nor against
thetower. She announced the next meeting for the neighborhood and encouraged
participation from interested parties.

2. Introduction
Lexcom Development is submitting this application for a new wireless telecommunication
facility on behalf of New Cingular Wireless PCS, LLC (AT&T) and the property owner, Calvary
Chapel of Eugene. The purpose of the proposed project is to fill a significant coverage gap in 4G
LTE technology (700 MHz) and improve all AT&T service the area. The proposed facility would
provide indoor, outdoor, and in-vehicle coverage within a geographic area not presently served
by AT&T’s high band 4G LTE technology.
The proposed project meets all of the City of Eugene’s criteria for siting a new wireless
telecommunication facility, including height, setbacks and design. (AT&T requests a variance
from the City’s requirement for underground ancillary equipment in light of the stealth design of
the equipment shed.) As shown throughout this application, AT&T’s proposal is the least intrusive
means of meeting AT&T’s coverage objectives. The proposed project also complies with the goals

of the 2004 Eugene-Springfield Metropolitan Area General Plan (“Metro Plan”). AT&T
respectfully requests that the City of Eugene approve the facility as proposed.
3. Proposal
3.1 Project Overview
The proposed wireless telecommunication facility is located at the Calvary Chapel of Eugene at
the corner of Fox Hollow Road and West Amazon Drive. The area is zoned Low Density
Residential (R1). The proposedstructure is a 75-foot tall monopine, which is a “stealth” cell
tower, designed to look like the pine trees native to the region and minimize negative visual
impacts. The 70-foot antenna tip height is the minimum height necessary to fill the targeted
high band 4G LTE coverage gap. The proposed ancillary equipment structure also uses a stealth
designit is an extension of the existing chapel, designed to match the chapel’s architecture.

3.2 Network Information & Site Selection
AT&T is upgrading and expanding its wireless communications network throughout Oregon,
including the installation of the latest high band 4G LTE technology at the proposed site. Upon
completion of this update, AT&T will operate a state-of-the-art digital network of wireless
communications facilities throughout the proposed coverage area as part of its nationwide
wireless network.
LTE stands for “Long Term Evolution.” This acronym refers to the ongoing process of improving
wireless technology standards, with 4G bringing broadband speeds up to ten times faster than
3G. LTE technology is the next step in increasing broadband speeds to meet the demands of uses
and the variety of content accessed over mobile networks.
AT&T constructs wireless communication facilities at carefully selected locations. The need for
service in this particular geographic area was determined by market demand, coverage
requirements for a specific geographic area, and the need to provide continuous coverage from
one site to another.
For this project, AT&T considered the maps showing existing 4G LTE coverage in the area and
determined there is a significant high band 4G LTE coverage gap in the area of Fox Hollow Road
and West Amazon Drive. See Att. 11: RF Coverage Map, “Exhibit 1A-Existing 4G Service Coverage
Map.”
Once the need for additional coverage was established, AT&T’s RF engineers performed a study
to determine the approximate site location and antenna height required to provide service in the
desired coverage area. Using a computer modeling program that accounts for the terrain within
the service area and other variables, such as proposed antenna height, available radio
frequencies and wireless equipment characteristics, the engineers identified a “search ring,”

wherein a site could be located to fill the coverage gap.See Att.13: Search Ring. The engineers
took the following objectives into consideration when identifying the search ring:
1.Coverage. The antenna site must be located in an area where the radio frequency
broadcasts will provide adequate coverage within the significant gap in coverage. The RF
engineer must take into consideration the coverage objectives for the site as well as the
terrain in and around the area to be covered. Since radio frequency broadcasts travel in
a straight line and diminish as they travel further away from the antennas, it is generally
best to place an antenna site near the center of the desired coverage area. However, in
certain cases, the search ring may be located away from the center of the desired
coverage area due to the existing coverage, the surrounding terrain, or other features
which might affect the radio frequency broadcasts like buildings or sources of electrical
interference.
2.Clutter. AT&T’s antennas must “clear the clutter” in the area. The radio frequencies used
in AT&T’s systems are adversely affected by trees, buildings, and other natural and man-
made obstacles. AT&T’s radio frequencies do not penetrate mountains, hills, rocks or
metal, and its radio frequencies are diminished by trees, brick and wood walls, and other
structures. Therefore, AT&T’s antennas must be installed above or close to the “clutter”
in order to provide high quality communications services in the desired coverage areas.
In addition, if the local code requires us to accommodate additional carriers on the
structure, the structure must be even higher in order to allow the other carriers’ antennas
to clear the clutter as well.
3.Call Handoff. The antenna site must be located in an area where the radio broadcasts
from this site will allow seamless call handoff with adjacent sites. “Call handoff” is a
feature of a wireless communications system which allows an ongoing telephone
conversation to continue uninterrupted as the user travels from the coverage area of one
antenna site into the coverage area of an adjacent antenna site. This requires coverage
overlap for a sufficient distance and/or period of time to support the mechanism of the
handoff.
4.Quality of Service. Users of wireless communications services want to use their services
where they live, work, commute and play, including when they are indoors. AT&T’s
coverage objectives include the ability to provide indoor coverage in areas where there
are residences, businesses and indoor recreational facilities.
5.Radio Frequencies used by System. The designs of telecommunications systems will vary
greatly based upon the radio frequencies that are used by the carrier. If the carrier uses
radio frequencies that are in the 850 MHz to 950 MHz range, the radio signals will travel
further and will penetrate buildings better than radio frequencies in the 1900 MHz band.
6.Land Use Classifications. AT&T’s ability to construct a cell site on any particular property
is affected by Oregonstate law and Eugene city code.

AT&T’s coverage propagation software systems use these and other factors (type of antenna,
antenna tilt, etc.) to predict the coverage that will be provided by the proposed site.
When this technical analysis was completed for this project, a search ring map was provided to
AT&T’s site development specialists. The approximate search ring boundaries for this project are:

Usingthis information, AT&T ranked potential sites. Whenever feasible, AT&T strives to site its
projects on property that is properly zoned and adjacent to compatible land uses. AT&T attempts
to select a location and design that minimizes negative visual impacts to the greatest extent
possible. Sites adjacent to existing tall power lines, antenna facilities, water treatment facilities,
and on the tops of buildings are selected when they meet the technical requirements of the
system. Rooftop and utility pole applications are favored where the design can be screened or
incorporated into the existing structure and mechanical equipment can be placed out of view.
New, freestanding towers and poles are amongthe last design options to be considered.
After viewing the area, the locationsconsidered included various light poles and utility poles
surrounding the Fox Hollow area and Amazon Drive area, in addition topotential new build sites.
Sites were eliminated from consideration due to zoning ordinances prohibitingthe location,
insufficient room for mechanical equipment, required setbacks that could not be achieved,or
property where a lease could not be acquired. A table outlining the analyses of alternative sites
considered is below (in the response to application submittal requirement EC 9.5750(6)(c)2).
Three coverage maps are attached as Exhibits to Attachment 11: RF Coverage Maps. Exhibit 1A
demonstrates the existing level of service. Exhibit 1B demonstrates the service that will be
provided by the new location at a height of 75 feet (antenna tip height). Exhibit 1C demonstrates
the service that would be provided from an alternative sitean existing light standard.
The areas shaded in green on the maps indicate where an AT&T wireless device can be reliably
used to make and receive telephone calls. The terrain, foliage, nearby structures,
and telecommunication facility location are taken into account. The further the distance from
the facility, or the more abundant the clutter (trees, buildings, etc.) between the facility and the
wireless device, the weaker the signal will be.
Other factors, not represented on the RF Coverage Maps, include the ability of the site to handle
the required call capacity and to provide the extent of data and other services required by AT&T
customers. The proposed site is designed to provide coverage consistent with these factors.
AT&T’s RF engineers have determined that at the proposed location, a 70-foot antenna tip height

(for a total 75-foot pole height) is the minimum necessary to achieve AT&T’s 4G LTE coverage
objectives.
The proposed monopole is designed to look like an evergreen treea monopine. AT&T chose
this stealth design as the best option for integration with the natural landscapeof this primarily
residential area, which is already surrounded by tall evergreen trees. This design will have the
least intrusive visual impact.
This proposed project would allow AT&T to provide high band 4GLTEcoverage where there is
currently a significant 4G LTE coverage gap, and allow for uninterrupted wireless service with
fewer dropped calls, improved call quality, and improved access to additional wireless services
that the public now demands. This includes emergency 911 calls throughout the area.
5. Applicable Law
Federal, state and local laws will apply to this application.
Under the Telecommunications Act, the City of Eugene is prohibited from considering the
environmental effects (including health effects) of the proposed site if the site will operate in
compliance with federal regulations. 47 U.S.C. Section 332(c)(7)(B)(iv). AT&T has included with
this application a report titled Non-Ionizing Electromagnetic Exposure Analysis prepared by
Hatfield & Dawson as Attachment 06 that demonstrates the proposed facility will operate in
accordance with the Federal Communications Commission’s (FCC) RF Emissions regulations.
Therefore, this issue is preempted under federal law and any testimony or documents
introduced relating to the environment or health effects of the proposed site should be
disregarded in this proceeding.
Additionally, the Telecommunications Act requires local jurisdictions to act upon applications
for wireless communications sites within a ‘reasonable’ time. The FCC has issued a ‘Shot Clock’
rule to establish a deadline for the issuance of land use permits for wireless facilities. According
to the FCC, a reasonable period of time for local government to act on wireless applications is
90-days for a co-location application and 150-days for all other applications. This time period
includes all application notice and appeal periods. The reasonable period for the City of Eugene
to review this application is 150-days.
The applicable local laws are addressed below.
6. Application Submittal Requirements: Eugene City Code and Metro Plan
AT&T’s proposal complies with thesubmittal requirements of the Eugene City Code and the
goals of the Metro Plan. These are addressed in the order laid out below.

Code provisions that are inapplicable to this proposed project have been excluded from the
analysis below.
City staff completed the pre-application review on August 23, 2013. Staff emphasized the
importance of seeking out alternative sites on existing EWEB utility poles in the area, and in
evaluating the feasibilityof locating the site in the city parknear the proposed site. AT&T’s
alternative site analysis, in response to EC 9.5750(6)(c)2, addresses these sites and others.
9.2740Residential Zone Land Use and Permit Requirements.The following Table
9.2740 Residential Zone Land Use and Permit Requirements identifies those
uses in the residential zones that are:

Response: The proposed project is subject to the requirements of 9.5750 Special Development
Standards for Telecommunication Devices, and will be reviewed as a 9.8090 Conditional Use
Permit.
9.5750 Telecommunication Devices-Siting Requirements and Procedures.
(1) Purpose. The provisions of this section are intended to ensure that
telecommunication facilities are located, installed, maintained and removed in
a manner that:
(a) Minimizes the number of transmission towers throughout the community;
(b) Encourages the collocation of telecommunication facilities;
(c) Encourages the use of existing buildings, light or utility poles or water
towers as opposed to construction of new telecommunication towers;
(d) Recognizes the need of telecommunication providers to build out their
systems over time; and

(e) Ensures that all telecommunication facilities, including towers, antennas,
and ancillary facilities are located and designed to minimize the visual
impact on the immediate surroundings and throughout the community,
and minimize public inconvenience and disruption. Nothing in this section
shall apply to amateur radio antennas, or facilities used exclusively for the
transmission of television and radio signals.
(2) Siting Restricted. No telecommunication facility, as defined in this land use
code, may be constructed, modified to increase its height, installed or otherwise
located within the city except as provided in this section. Depending on the
type and location of the telecommunication facility, the telecommunication
facility shall be either an outright permitted use, subject to site review
procedures, or require a conditional use permit.

(c) Conditional Use Permit. A telecommunication facility which, pursuant to
subsections (4) or (5) of this section, requires a conditional use permit shall
be processed in accordance with the conditional use permit procedures of
this land use code, except that the variance provisions shall not apply. The
criteria contained in EC 9.8090 Conditional Use Permit Approval Criteria -
General and subsections (6) and (7) of this section shall govern approval or
denial of the conditional use permit application. In the event of a conflict
in criteria, the criteria contained in subsections (6) and (7) of this section
shall govern. No development permit shall be issued prior to completion
of the conditional use permit process, including any local appeal.
Response: See the Responses to the applicable provisions of EC 9.8090 Conditional Use Permit
Approval CriteriaGeneral, below.
(5)Construction of Transmission Tower. Construction of a transmission tower, or a
modification of an existing transmission tower to increase its height, shall be
allowed as follows:
(c) Conditional Use Permit. Such construction shall require a conditional use
permit in the R-1, C-1, S (other than S-WS) and GO zones.
Response: As noted above, the proposed project is within an R-1 zone and will require a
conditional use permit.
(6)Application Requirements.
********
(b) Construction of Transmission Tower. In addition to standard required
application material, an applicant for a transmission tower shall submit

the following information; additional application material is required, as
specified in paragraph (c) below, for applications requiring a site review
or conditional use process:
1. A description of the proposed tower location, design and height.
Response: AT&T proposes installation of a 75-foot monopole designed to look like an evergreen
tree (‘monopine’) located in an R-1 Low Density Residential zone at 4060 West Amazon Drive. All
associated equipment will be located in a proposed equipment shed designed to match the
existing structure. Details of the design are shown in Attachment 04: Site Plan.
2. The general capacity of the tower in terms of the number and type of
antennas it is designed to accommodate.
Response: The proposed monopineis designed to accommodate at leasttwo carriers. The design
includes 12 AT&T antennasat a tip height of70 feet. Future collocation below AT&T’s antennas
will be possible at this site, depending on a future tenant’s technology and coverage needs.
Details of thisdesign are shownin Attachment 04: Site Plan, page A-3.0 and A-3.1.
3. Documentation demonstrating compliance with non-ionizing
electromagnetic radiation (NIER) emissions standards as set forth by
the Federal Communications Commission (FCC).
Response: The proposed site complies with the FCC’s NIER emissions standards. See Attachment
06: NIER Report.
4. A signed agreement, as supplied by the city, stating that the applicant
will allow collocation with other users, provided all safety, structural,
and technological requirements are met. This agreement shall also
state that any future owners or operators will allow collocation on the
tower.
Response: AT&T will sign the provided agreement or it may be made a condition of approval.
5. Documentation that the ancillary facilities will not produce sound levels
in excess of those standards specified in subsection (7) of this section, or
designs showing how the sound is to be effectively muffled and reduced
pursuant to those standards.
Response: The proposed ancillary facility will not produce noise greater than 45 dBA, which is the
maximum noise level allowed on property zoned R-1. See Attachment 07: Sound Study.

vegetation is proposed as the site is already well landscaped.
7. Plans showing the connection to utilities/right-of-way cuts required,
ownership of utilities and easements required.
Response: Utility connections are depicted at Attachment 04: Site Plan,page A-1.0.
8. Documents demonstrating that necessary easements have been
obtained;
Response: The easements necessary for this project will be included in the lease with the property
owner.
9. Plans showing how vehicle access will be provided;
Response: Vehicular access is depicted at Attachment 04: Site Plan, page A-1.0.
10. Signature of the property owner(s) on the application form or a
statement from the property owner(s) granting authorization to
proceed with development permit and land use processes;
Response: The property owner’s signature is on the CUP application form.
11. Documents demonstrating that the FAA has reviewed and approved
the proposal, and Oregon Department of Aviation has reviewed the
proposal. Alternatively, when a site review or conditional use process
is required, submit a statement documenting that notice of the
proposal has been submitted to the FAA and Oregon Department of
Aviation. The site review or conditional use process may proceed and
approval may be granted for the proposal as submitted, subject to FAA
approval. If FAA approval requires any changes to the proposal as
initially approved, then that initial approval shall be void. A new
application will need to be submitted, reviewed and approved through
an additional site review or conditional use process. No development
permit application shall be submitted without documents
demonstrating FAA review and approval and Oregon Department of
Aviation review.
Response: See Attachment 08: ODA Letter and Attachment 09: TOWAIR Determination. No
lighting or marking is required.
(c) Site Review and Conditional Use Permit Applications. In addition to the
application requirements specified in paragraph (b) above, applications
for site review or conditional use permits also shall include the following
information:

1. A visual study containing, at a minimum, a graphic simulation showing
the appearance of the proposed tower, antennas, and ancillary
facilities from at least 5 points within a 3 mile radius. Such points
shall be chosen by the provider with review and approval by the
planning director to ensure that various potential views are
represented.
Response: Photo simulations of the proposed site are at Attachment 10: Photo Simulations.
2. Documentation that alternative sites within a radius of at least 2000
feet have been considered and have been determined to be
technologically unfeasible or unavailable. For site reviews, alternative
sites zoned C-4, I-1, I-2, and I-3 must be considered. For conditional
use permits, alternative sites zoned PL, C-2, C-3, C-4, I-1, I-2, I-3 and S-
WS must be considered.
Response: Based on an extensive RF design analysis, a search ring was issued to locate a site to
fill asignificanthigh band 4G LTE coverage gap and improve service in an area targeting Fox
Hollow and Amazon Drive. This area is zoned R-1. Significant deviation from this location would
make any attempt to solve the 4G LTE coverage gap in the area ineffective.See above, “Site
Selection,” for further explanation about AT&T’s alternative site analysis process.

with a potential antenna tip height of 52’. At this
limited height, coverage suffers significantly to the
north, south and west, leaving a combined gap in
coverage of approximately 1.5–2 miles.

Response: There are no existing buildingsofsufficient heightthat will meet AT&T’s coverage
goals.Existing light/utlity poles in the search ring are of insufficient height to meet service
coverage needs at +/- 30’ (as discussed above in the alternative site review). There are no existing
wireless tower facilities or water towers in the area on which to collocate.

represent AT&T sites that are currently in operation and the green dots represent sites that have
been approved for AT&T development. The approved sites are in various stages of development.

5. A statement providing the reasons for the location, design and height
of the proposed tower or antennas.
Response: AT&T is experiencing a significant 4G LTE coverage gap in south Eugene. The
installation of the proposed monopine at Fox Hollow Road and West Amazon Drive will fill this
gap and, in conjunction with adjacent sites, provide adequate voice and data coverage to the
south Eugene area. See above at Section IV: Site Selection for a detailed explanation of AT&T’s
site and design selection process. See also Attachment 11: RF Coverage Maps.
(7) Standards for Transmission Towers and Antennas. Installation, construction or
modification of all transmission towers and antennas shall comply with the
following standards, unless a variance is obtained pursuant to the provisions of
subsection (9) of this section:
(a)Separation betweenTransmission Towers. No transmission tower may
be constructed within 2000 feet of any pre-existing transmission tower.
Tower separation shall be measured by following a straight line from the
portion of the base of the proposed tower which is closest to the base of
any pre-existing tower. For purposes of this paragraph, a tower shall
include any transmission tower for which the city has issued a
development permit, or for which an application has been filed and not
denied. Transmission towers constructed or approved prior to February
26, 1997 may be modified to accommodate additional providers
consistent with provisions for collocation in this section.
Response: There no registered towers within 2000 feet of the site proposed herein per a search
completed on the FCC’s Antenna Structure Registration website at
http://wireless.fcc.gov/antenna/index.htm?job=home.
(b) Height Limitation: Transmission tower heights shall be governed by this
section except as provided for below. No transmission tower shall exceed
the maximum heights provided below. In no case shall a variance be
granted from the limitations of subparagraphs (1) through (4) below.
1. In any zones, no transmission tower shall exceed the height
limitations established for buildings and structures in the specified
areas surrounding Skinner Butte contained in EC 9.6715 Height
Limitation Areas of this land use code to protect views to and from
Skinner Butte.
2. In any zone within the area east of Willagillespie Road, south of Cal
Young Road, west of Oakway Road, and north of Southwood Lane and
Country Club Road, no transmission tower shall exceed 75 feet in
height to protect views to and from Gillespie Butte.

3. If located within a PL, C-2, C-3, C-4, R-4, I-1, I-2, I-3 or S-WS zone, the
height limitation for that zone shall apply.
4. If located within a C-1, S (other than S-WS) or GO zone, the maximum
height of a transmission tower, including antennas, is 100 feet.
5. If located within an R-1 zone, the maximum height of a transmission
tower, including antennas, is 75 feet, unless a variance is granted
pursuant to the provisions of subsection (9) of this section. In no
event shall a variance be granted to construct such a tower in excess
of 100 feet.
Response: The site does not fall into a viewshed for any of the above-mentioned Buttes and does
not exceed the maximum height restriction of the underlying R-1 zoning designation of 75feet.
(c) Collocation. New transmission towers shall be designed to accommodate
collocation of additional providers:
********
2. New transmission towers of a height of at least 60 feet and no more
than 80 feet shall be designed to accommodate collocation of a
minimum of 1 additional provider either outright or through future
modification to the tower.
Response: The proposed monopineis designed to accommodate twelve AT&T antennasat the
top and can also accommodate twelve antennas belonging to a collocator(s). See Attachment
04: Site Plans, page A-3.0 and A-3.1
(d) Setback. The following setbacks from adjacent property lines and
adjacent streets shall be required unless a variance is granted pursuantto
the provisions of subsection (9) of this section:
2. If located within an R-1, C-1, or GO zone, the transmission tower shall
be set back from adjacent property lines a minimum number of feet
that is equal to the height of the transmission tower.
3. In the R-1, PL, C-1 and GO zones, transmission towers shall be set back
from adjacent public street(s) a minimum number of feet that is equal
to the height of the tower. In all other zones, the setback from
adjacent public streets shall be a minimum of 25 feet.
Response: The proposed project design has a setback from the adjacent property lines(at Fox
Hollow Road and Amazon Drive) of at least 75 feet, which is equal to the total height of the
proposed tower. See Att. 04: Site Plan.

(e) Buffering. In all zones, existing vegetation shall be preserved to the
maximum extent possible. In the C-4, I-1, I-2 and I-3 zones, no buffering is
required beyond that required by this land use code. In all other zones,
landscaping shall be placed completely around the transmission tower
and ancillary facilities located at ground level except as required to access
the facility. Such landscaping shall consist of evergreen vegetation with a
minimum planted height of 6 feet placed densely so as to form a screen.
Landscaping shall be compatible with other nearby landscaping and shall
be kept healthy and well maintained.
Response: Theproposed project is a stealth transmission tower designed to look like an evergreen
tree (monopine) and surrounded by a 6-foot tall cedar fence. The equipment shed is designed to
look like an extension of the chapel on the property. The mature trees and existing vegetation
along the perimeter of the property will be preserved to buffer the view of the site from adjacent
properties.The mature trees are detailed at Attachment 04: Site Plan, SV1, as submitted with this
application.
(f) Noise Reduction. In R-1, R-2, R-3, R-4, C-1, and GO and in all other zones
when the adjacent property is zoned for residential use or occupied by a
dwelling, hospital, school, library, or nursing home, noise generating
equipment shall be sound-buffered by means of baffling, barriers, or
other suitable means to reduce sound level measured at the property line
to 45 dBa.
Response: Sound from the ancillary equipment for this project will be at or below 45 dBA, and
thus meets this code requirement. Please see Attachment 07: Sound Study.
(g) Status of Location. No permit may be issued for the location of a new
telecommunications facility within an R-1 or C-1 zone unless the lot on
which it is to be placed is vacant or developed with a non-residential use
at the time the permit application is submitted. This restriction does not
apply within other zones.
Response: This proposal is located on a property zoned R-1 currently developed with a non-
residential use, a Church.
(h) Lighting. No lighting shall be permitted on transmission towers except
that required by the Federal Aviation Administration. No high intensity
white lights may be located on transmission towers in an R-1, C-1, or PRO
zone.
Response: No onsite lighting is required or proposed.
(i)Color. The transmission tower and attached antennas shall be unpainted
galvanized steel or painted neutral colors or such shades as are

appropriate and compatible with the surrounding environment, as
approved by the city.
Response: The proposed project is for a monopole designed to mimic the look of an evergreen
tree, typically referred to as a monopine. The antenna will be painted a neutralgreen to match
the monopine “branches.” See Attachment 10: Photo Simulations.
(j) Viewshed. The transmission tower shall be located down slope from the
top of a ridgeline so that when viewed from any point along the northern
right-of-way line of 18th Avenue, the tower does not interrupt the profile
of the ridgeline or Spencer Butte. In addition, a transmission tower shall
not interrupt the profile of Spencer Butte when viewed from any location
in Amazon Park. Visual impacts to prominent views of Skinner Butte,
Judkins Point, and Gillespie Butte shall be minimized to the greatest
extent possible. Approval for location of a transmission tower in a
prominent view of these Buttes shall be given only if location of the
transmission tower on an alternative site is not possible as documented
by application materials submitted by the applicant, and the transmission
tower is limited in height to the minimum height necessary to provide the
approximate coverage the tower is intended to provide.
Response: The proposed facility is not within the viewshed of any of the above-mentioned Buttes,
and is not on a ridgeline.
(k) Display.No signs, striping, graphics or other attention getting devices are
permitted on the transmission tower or ancillary facilities except for
warning and safety signage with a surface area of no more than 3 square
feet. Such signage shall be affixed to a fence or ancillary facility and the
number of signs is limited to no more than 2.
Response: No signs, striping, graphics or lighting is proposed for this site other than as required
by Federal, state or local lawand shall be no greater than 3 x 3.
(8) Standards for Ancillary Facilities. All ancillary facilities shall comply with the
standards of subsections (7)(e) and (7)(f) of this section. In addition, all ancillary
facilities within an R-1, PL, C-1, GO, and PRO zone must be located underground
to the maximum extent technology allows, unless a variance is obtained
pursuant to the provisions of subsection (9) of this section. This restriction does
not apply within other zones.
Response: AT&T seeks a variance to place the ancillary facilities for this project aboveground,
pursuant to the specific variance criteria listed in subsection (9) below. The applicable criteria for
the variance to the undergrounding requirement are contained in (9)(c), and subject to review as
outlined in (9)(a) and (9)(e).
(9) Variance.

(a) Any variance to the requirements of this section shall be granted only
pursuant to the following provisions. The criteria for granting a variance
shall be limited to this section, and shall not include the standard variance
criteria beginning at EC 9.8750 Purpose of Variances.

(c) The city may grant a variance to the setback and undergrounding
requirements of subsections (7)(d) or (8) upon finding that stealth design,
proposed landscaping, configuration of the site, or the presence of mature
trees obviates the need for compliance.
(e)If the proposed transmission tower or ancillary facility requires site review
or a conditional use permit, the request for variance shall be considered as
part of the site review or conditional use permit process. If the proposed
transmission tower or ancillary facility is an outright permitted use, the
request for a variance shall be processed pursuant to Type II application
procedures beginning at EC 9.7200 General Overview of Type II Application
Proceduresexcept that the decision shall be based on the criteria in this
section.
Response: AT&T requests a variance to the undergrounding requirement based on the design of
the equipment enclosure. The proposed design will be a fully enclosed shed/storage room, which
will look like, and double as, an accessory building to the existing property use. AT&T will
construct the building so that part of it is allocated to the telecommunication facility, and the
other part will function as a storage area for the property owner. The design and colors are
designed to match those of the chapel. Because this project requires a conditional use permit,
this variance request is considered a part of the conditional use permit process.
(11) Application Review and Fees. The city manager shall retain one or more
consultants to verify the accuracy of statements made in connection with an
application for a building or land use permit for a telecommunications facility.
Notwithstanding any other provision of this code, the city manager shall require
the applicant to pay, as part of the application fees, an amount sufficient to
recover all of the city’s costs in retaining the consultant(s).
Response: Application fees have been included with this proposal sufficient to cover the
Conditional Use Permit and the consultant fee to review the NIER report.

9.8090 Conditional Use Permit Approval Criteria -General. A conditional use permit shall be
granted only if the proposal conforms to all of the following criteria:
(1)The proposal is consistent with applicable provisions of the Metro Planand
applicable refinement plans.
Response: The proposed project is within the Urban Growth Boundary as shown on the Metro
Area General PlanPlan Diagram.
Environmental Design Element: Policy E.4 of the Environmental Design Element says, “Public and
private facilities shall be designed and located in a manner that preserves and enhances desirable
features of local and neighborhood areas and promotes their sense of identity.”
The proposed project forwards PolicyE.4 by enhancing a desirable featurereliable wireless
servicewhile preserving the desirable features and identity of the neighborhood. The proposed
telecommunication facility, a monopine, is designed to blend in with the otherevergreen trees in
the area. The ancillary equipment shed will be an extension of the existing chapel on the property,
and will match the existing architecture of that structure.
Public Facilities and Services Element (Services Element): The statement of intent for the Services
Element notes,
As the population of the Eugene-Springfield area increases and land development
patterns change over time, the demand for urban services also increases and
changes. These changes require that service providers, both public and private,
plan for the provision of services in a coordinated manner, using consistent
assumptions and projections for population and land use.
Goal 1 of the Services Element states, “Provide and maintain public facilities and services in an
efficient and environmentally responsible manner.”
The proposed project forwards the intent of the Services Element and its Goal 1 by providing
reliable communications services to the community, and doing so in a manner that encourages
future collocation of other providers. Collocation avoids the need for construction of additional
telecommunication facilities, thus promoting the efficient and environmentally responsible
provision of public services, as stated in Goal 1.
The proposed project also forwards policies under the Services Element. Policy G1 states,
Extend the minimum level and full range of key urban facilities and services in an
orderly and efficient manner consistent with the growth and management policies
in Chapter II-C, relevant policies in this chapter, and other Metro Plan policies.
Wireless services are key to growing urban areaspeople rely on the ability to use their phones
and other wireless devices at work and at home, both indoors and outdoors. The proposed project
will extend wireless service to the surrounding community in an orderly and efficient manner as

outlined in Eugene’s city code. (See above.)
Policy G7 states, “Service providers shall coordinate the provision of facilities and services to areas
targeted by the cities for higher densities, infill, mixed uses, and nodal development.”
As noted above, the proposed monopine is sited within the UGB, and would accommodate at least
two carriers, allowing the opportunity for service providers to coordinate collocation and serve a
growing population.
(2)The location, size, design, and operating characteristics of the proposal are
reasonably compatible with and have minimal impact on the livability or
appropriate development of surrounding property, as they relate to the
following factors:
(a)The proposed building(s) mass and scale are physically suitable for the
type and density of use being proposed.
(b) The proposed structures, parking lots, outdoor use areas or other site
improvements which could cause substantial off-site impacts such as
noise, glare and odors are oriented away from nearby residential uses
and/or are adequately mitigated through other design techniques, such
as screening and increased setbacks.
(c) If the proposal involves a residential use, the project is designed, sited
and/or adequately buffered to minimize off-site impacts which could
adversely affect the future residents of the subject property.
Response: As described above, the proposed telecommunication facility is designed to have
minimal impact on the surrounding property. The monopine is designed to look like other
evergreen trees in the immediate area, and the ancillary equipment shed will look like (and
function as, in part) an extension of the chapel already existing on the property. The project meets
the noise and setback requirements of the EC.
(3) The location, design, and related features of the proposal provides a
convenient and functional living, working, shopping or civic environment, and
is as attractive as the nature of the use and its location and setting warrant.
Response: As described above, the proposed facility will look like other trees and structures in
the neighborhood. Further, the enhanced wireless service provided by the proposed project
would add convenience and functionality to the surrounding areas.
(4) The proposal demonstrates adequate and safe circulation exists for the
following:
(a)Vehicular access to and from the proposed site, and on-site circulation
and emergency response.

(b) Pedestrian, bicycle and transit circulation, including related facilities, as
needed among buildings and related uses on the development site, as
well as to adjacent and nearby residential areas, transit stops,
neighborhood activity centers, office parks, and industrial parks,
provided the city makes findings to demonstrate consistency with
constitutional requirements. “Nearby” means uses within 1/4 mile that
can reasonably be expected to be used by pedestrians, and uses within
2 miles that can reasonably be expected to be used by bicyclists.
Response: The proposed project will have no impact on the existing vehicular access to and from
the proposed site, or to pedestrian, bicycle and transit circulation.
(5) The proposal is designed and sited to minimize impacts to the natural
environment by addressing the following:
(a) Protection of Natural Features.
1.For areas not included on the city’s acknowledged Goal 5 inventory,
the preservation of significant natural features to the greatest
degree attainable or feasible, including:
a. Significant on-site vegetation, including rare plants (those that
are proposed for listing or are listed under state or federal law),
and native plant communities.
b. All documented habitat for all rare animal species (those that
are proposed for listing or are listed under state or federal law).
c. Prominent topographic features, such as ridgelines and rock
outcrops.
d. Wetlands, intermittent and perennial stream corridors and
riparian areas.
e. Natural resource areas designated in the Metro Plandiagram as
“Natural Resource” and areas identified in any city-adopted
natural resource inventory.
2. For areas included on the city’s acknowledged Goal 5 inventory, the
preservation of natural features shall be consistent with the
acknowledged level of preservation provided for the area.
(b) Tree Preservation. The proposed project shall be designed and sited to
preserve significant trees to the greatest degree attainable or feasible,
with trees having the following characteristics given the highest priority
for preservation:

1. Healthy trees that have a reasonable chance of survival considering
the base zone or special area zone designation and other applicable
approval criteria
2. Trees located within vegetated corridors and stands rather than
individual isolated trees subject to windthrow.
3. Trees that fulfill a screening function, provide relief from glare, or
shade expansive areas of pavement.
4. Trees that provide a buffer between potentially incompatible land
uses.
5. Trees located along the perimeter of the lot(s) and within building
setback areas.
6. Trees and stands of trees located along ridgelines and within view
corridors.
7. Trees with significant habitat value
8. Trees adjacent to public parks, open space and streets.
9. Trees along water features.
10. Heritage trees.
(c) Restoration or Replacement.
1. For areas not included on the city’s acknowledged Goal 5 inventory,
the proposal mitigates, to the greatest degree attainable or feasible,
the loss of significant natural features described in criteria (a) and
(b) above, through the restoration or replacement of natural
features such as:
a. Planting of replacement trees within common areas; or
b.Re-vegetation of slopes, ridgelines, and streamcorridors; or
c. Restoration of fish and wildlife habitat, native plant habitat,
wetland areas, and riparian vegetation.
To the extent applicable, restoration or replacement shall be in
compliance with the planting and replacement standards of EC
6.320.

2. For areas included on the city’s acknowledged Goal 5 inventory, any
loss of natural features shall be consistent with the acknowledged
level of preservation provided for the resource.
(d) Street Trees. If the proposal includes removal of any street tree(s),
removal of those street tree(s) has been approved, or approved with
conditions according to the process at EC 6.305 of this code.
Response: The proposed project will have minimal impact on the natural environment. Trees
and landscaping in the area will remain intact.
(6) The proposal provides adequate public facilities and services including, but not
limited to utilities, streets, and other infrastructure.
Response: The proposed project would not create a need for additional public facilities or
services. The proposed project would add to enhanced wireless service to the existing public
services in the area.
(7) The proposal does not create any significant risk to public health and safety,
including but not limited to soil erosion and flood hazard, or an impediment to
emergency response.
Response: The proposed facility will notcreate any significant risk to public health and safety.
The proposed project may enhance emergency communications.
(8) The proposal complies with all applicable standards, including but not limited
to:
(a)EC 9.2000 through 9.3915 regarding lot dimensions, solar standards,
and density requirements for the subject zone;
(b) EC 9.6500 through EC 9.6505 Public Improvement Standards;
(c) EC 9.6735 Public Access Required.
(d) EC 9.6791 through 9.6797 regarding stormwater destination, pollution
reduction, flow control for headwaters area, oil control, source control,
easements, and operation and maintenance; and
(e) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and other
Public Ways;
(f)Where the proposal is to establish non-residential uses subject to
residential density requirements on development sites in the residential
zone category, it shall achieve the minimum and maximum density
requirements in accordance with Table 9.2750 Residential Zone

Development Standards, unless specifically exempted elsewhere in this
code or granted a modification through an approved conditional use
permit. For purposes of calculating “net density,” the acreage of land
considered shall include the entire development site and exclude public
property, such as public streets, parks, and other public facilities. In
considering whether to grant a modification to the density
requirements, the hearings official shall evaluate the following factors:
1. The availability of the development site for residential use on
August 1, 2001. The term “availability” in this section shall include
consideration of whether the site was already developed with non-
residential uses or had other site constraints impacting its suitability
for residential use.
2. The necessity of the development site to be developed with
residential uses to be able to achieve the minimum residential
density for the area designated on the Metro Plan Land Use Diagram
for either medium- or high-density residential use.
3. Adopted plan policies indicate the suitability and appropriateness of
the site for non-residential use.
An approved adjustment to a standard pursuant to the provisions
beginning at EC 9.8015 of this land use code constitutes compliance
with the standard. Additional criteria may also be required based on
the applicability of other sections of this land use code.
Response: As described above, the project complies with all applicable standards in the EC.
(9) The proposal complies with the Traffic Impact Analysis Review
provisions of EC 9.8650 through 9.8680 where applicable.
Response: The proposed project will have no impact on traffic.
7. Conclusion
New Cingular Wireless PCS, LLC proposal meets all requirements of the City of Eugene land use
code. As such, AT&T respectfully requests that the City of Eugene approve this project as
proposed.

Dear Danielle,
This report presents a property line noise study for the proposed AT&T telecommunications facility
at 4060 West Amazon Drive in Eugene, Oregon. This noise study extends from the proposed
equipment to the nearest receiving properties. The purpose of this report is to document the
existing conditions and the impacts of the acoustical changes due to the proposed equipment.
This report contains data on the existing and predicted noise environments, impact criteria and
an evaluation of the predicted sound levels as they relate to the criteria.
Ambient Conditions
Existing ambient noise levels were measured on site with a Larson-Davis 820 sound level meter
on February 6, 2014. Measurements were conducted as close to the receiving property lines
nearest the proposed location as possible in accordance with Oregon Administrative Rules (OAR)

local traffic on Amazon Road. The weather during the measurements was cloudy and the roads
were snowy.
Code Requirements
The site is located within the City of Eugene Zoning jurisdiction on property with an R-1
(Residential) zoning designation. All of the receiving properties are also zoned Residential.
The proposed new equipment consists of equipment support cabinets, which are expected to run
intermittently 24 hours a day.
Eugene City Code Chapter 9.5750.7.f limits noise being received by an R-1 or other residential
property to 45 dBA.

Predicted Equipment Sound Levels
24-Hour Operation Equipment
The equipment will be located in an equipment room served by two Marviar air conditioning units.
According to manufacturer data, the Marvair AVP36 air-conditioning which each produce 70 dB(A)
at 5 feet. The combined noise level from both units is 73 dBA at 5 feet.
To predict equipment noise levels at the receiving properties, this survey uses the methods
established by ASHRAE and AHRI Standard 275-2010. Application factors such as location,
height, and reflective surfaces, and noise reduction from intervening elements are accounted for
in predicting the sound level at the receiving properties.
The nearest receiving property line is approximately 113 feet West of the equipment and 129 feet
South of the equipment. The predicted sound level at the nearest property line is shown in the
table below.
