A time framework for a plan providing for clearing only in areas within <br />the proposed road system, meaning those areas located closest to the <br />existing cemetery but not beyond the proposed road. The second phase of <br />cutting involving the area south of the road will only be initiated after the <br />first phase is complete and after submittal and approval of a specific tree <br />survey showing diameter and species of any tree over 18" DBH in the <br />southern portion and a complete plan for the buffer area as required below. <br />"e. Tree clearing in each individual area. The first areas to be cleared are <br />those closest to the northern portion of the site, with the last areas to be <br />cleared on the southernmost portion of the site. <br />"f. Within buffer zones, removal of dead and hazardous trees and noxious <br />understory vegetation, and planting of native understory vegetation. <br />"g. Construction of interior access roads, irrigation systems, lawns, and <br />landscaping in areas proposed for tree clearing. This shall take place <br />promptly after tree clearing is completed in order to minimize fire <br />danger." Rec. 177. <br />Those criteria were noted as satisfied in the CUP Agreement by reference to specific pages of the <br />Approved Plans, specifically pages 1, 3, 4 and 6 of 8 of the Approved Plans. Rec 163-64. The <br />contents of those pages will be addressed later. <br />The above conditions embody key principles that impact trees on the project site. The <br />subject property is divided into two broad areas (described as Phases I and II on the masterplan <br />sheet 3 of 8 reproduced at 651), one which includes the proposed roads and property to the north <br />of those roads, and another which includes the property to the south of the proposed roads. The <br />CUP allows significant tree felling only in the area to the north of the proposed roads to occur in <br />the first phase of development. Major tree felling decisions for the area to the south are held off <br />until the second phase of development after other criteria are satisfied. The southern perimeter is <br />retained as a buffer area during phase one and the CUP permits only the removal of dead or <br />hazardous trees from the buffer areas and the planting of native understory vegetation. <br />b. Condition 5: Masterplan Revisions <br />The conditions of approval also specified that the Masterplan will be revised, before the <br />CUP Agreement can be signed, to expressly show specific aspects of the proposal. In general, <br />these conditions indicate that: (1) each of the items specified was before the Hearings Official <br />and expressly addressed by him; and (2) those items were revised on the Masterplan, to the <br />extent that the City was satisfied that the CUP conditions had been satisfied, before the City <br />signed the CUP Agreement. <br />
