File Memorandum: References to Tree Felling and Preservation in Rest-Haven CUP (CU 95-2)
August 28, 2002
CC* * * * *
"d. A time framework for a plan providing for clearing only in areas within
the proposed road system, meaning those areas located closest to the
existing cemetery but not beyond the proposed road. The second phase of
cutting involving the area south of the road will only be initiated after the
first phase is complete and after submittal and approval of a specific tree
survey showing diameter and species of any tree over 18" DBH in the
southern portion and a complete plan for the buffer area as required below.
"e. Tree clearing in each individual area. The first areas to be cleared are
those closest to the northern portion of the site, with the last areas to be
cleared on the southernmost portion of the site.
"f. Within buffer zones, removal of dead and hazardous trees and noxious
understory vegetation, and planting of native understory vegetation.
"g. Construction of interior access roads, irrigation systems, lawns, and
landscaping in areas proposed for tree clearing. This shall take place
promptly after tree clearing is completed in order to minimize fire
danger." Rec. 177.
Those criteria were noted as satisfied in the CUP Agreement by reference to specific pages of the
Approved Plans, specifically pages 1, 3, 4 and 6 of 8 of the Approved Plans. Rec 163-64. The
contents of those pages will be addressed later.
The above conditions embody key principles that impact trees on the project site. The
subject property is divided into two broad areas (described as Phases I and II on the masterplan
sheet 3 of 8 reproduced at 651), one which includes the proposed roads and property to the north
of those roads, and another which includes the property to the south of the proposed roads. The
CUP allows significant tree felling only in the area to the north of the proposed roads to occur in
the first phase of development. Major tree felling decisions for the area to the south are held off
until the second phase of development after other criteria are satisfied. The southern perimeter is
retained as a buffer area during phase one and the CUP permits only the removal of dead or
hazardous trees from the buffer areas and the planting of native understory vegetation.
b. Condition 5: Masterplan Revisions
The conditions of approval also specified that the Masterplan will be revised, before the
CUP Agreement can be signed, to expressly show specific aspects of the proposal. In general,
these conditions indicate that: (1) each of the items specified was before the Hearings Official
and expressly addressed by him; and (2) those items were revised on the Masterplan, to the
extent that the City was satisfied that the CUP conditions had been satisfied, before the City
signed the CUP Agreement.
