File Memorandum: References to Tree Felling and Preservation in Rest-Haven CUP (CU 95-2) <br />August 28, 2002 <br />Page 10 of 17 <br />Restoration planting of trees can be required at the fringe of the narrowest <br />portions of the proposed buffer area, in order to ensure tree survival within it. As <br />an alternative, widening of the buffer area at its narrowist points can be required." <br />Rec. 179. <br />The CUP Agreement indicated that Exhibit J was replaced with sheets 3 of 8 and 4 of 8 of the <br />Approved Plans and that the condition was to remain in effect to address the tree cutting <br />requirements. Rec. 166. The implication of the CUP Agreement is that the contents of those <br />sheets contain a tree preservation plan that replaced the one contained in the referenced Exhibit <br />J. <br />4. The Approved Plans <br />The Approved Plans contain several sheets that pertain to the issue of whether the CUP <br />and the Agreement addressed or resolved which trees were to be felled and which were to remain <br />on the property. Those sheets include: sheet 1 of 8, sheet 3 of 8, sheet 4 of 8, and sheet 6 of 8. <br />Each sheet is addressed in turn. <br />a. Sheet 1 of 8 <br />Sheet 1 of 8 is entitled "Cover Sheet." A reduced copy of that sheet is contained at Rec. <br />649. That sheet provides a 1 " = 100' - 0" scale drawing of the proposed development, a sheet <br />index of the Approved Plans, and a Legend. The legend provides, among other things, an <br />explanation of the symbols used to designate existing groups and individual trees to remain, <br />existing buffer to remain, and proposed roads. <br />b. Sheet 3 of 8 <br />Sheet 3 of 8 is entitled Tree Phasing/Clearing Plan. A reduced copy of that sheet is <br />contained at Rec. 651. That sheet contains several items to be addressed here. <br />The general phasing plan, with Phase 1 consisting of the area north of the proposed roads <br />and Phase 2 consisting of the buffer area to the south of the proposed road, is indicated by a <br />small diagram in the bottom right of the sheet. <br />The majority of the sheet is covered by the 1" = 100' - 0" scale drawing of the proposed <br />development. That drawing shows the logging staging areas, existing trees to remain with the <br />protective fencing for those trees indicated, and the existing buffer that is to remain. The legend <br />identifies the symbols used to designate each of those on the drawing. <br />Sheet 3 of 8 also contains a series of three "Notes:" trees and removal; general; and tree <br />protection.
