<br />Hearings Official Decision (WG 19-2) 5 <br />“(7) The proposal complies with all applicable standards explicitly <br />addressed in the application. An approved adjustment to a <br />standard pursuant to provisions beginning at EC 9.8015 of this <br />land use code constitutes compliance with the standard.” <br /> Under EC 9.8815(7) the proposal must comply “with all applicable standards explicitly <br />addressed in the application.” Conte argues that that includes the EC 9.6725 Outdoor Lighting <br />Standards. The staff report states that compliance with EC 9.6725 will be addressed as part of the <br />building permit process. Conte argues that the applicant must either demonstrate compliance <br />prior to approval, the City must impose a condition of approval that is adequate to ensure <br />compliance, or the City must defer the evaluation to a subsequent process with the same <br />opportunity for public participation. At the public hearing, the applicant submitted a detailed <br />outdoor lighting plan that addresses the requirements of EC 9.6725. The lighting plan <br />demonstrates that it meets the Dark Area lighting requirements of EC 9.6725(8)(a)(3) and the <br />Low Ambient Light Area lighting requirements of EC 9.6725(8)(b)(3). As the lighting plan <br />states: <br />“The proposed lighting fixtures are limited to exterior building lighting located <br />at the building entries for safety purposes. Consistent with these applicable <br />standards, the lighting fixtures are designed to direct light downward, and will <br />have an initial output of no more than 1500 lumens. Per EC 9.6725(3), all <br />proposed lighting fixtures will be cutoff and additional shielding, as necessary, <br />will be provided to direct the light within the boundaries of the development <br />site. Although the proposal meets the required standards at EC 9.6725(8)(a)(3) <br />and EC 9.6725(8)(b)(3), the proposed outdoor lighting does meet the <br />exemptions section EC 9.6725(5)(b).” <br /> I agree with the applicant’s expert that the outdoor lighting plan satisfies the requirements <br />of EC 9.6725(8)(a)(3) and EC 9.6725(8)(b)(3) and furthermore that the applicant also qualifies <br />for an exemption under EC 9.6725(5(b) because the proposed lighting will have an output of less <br />than 1500 lumens.3 EC 9.6725 and EC 9.8815(7) are satisfied. <br /> Opponent Daniel Lindley (Lindley) raises a number of objections to the application. Most <br />of those objections relate to traffic impacts which are addressed later. Lindley’s other objections <br />do not cite any approval criteria or explain why they are relevant. His arguments do not appear to <br /> <br />3 EC 9.6725(5)(b) provides for an exemption to the outdoor lighting standards for: “A lighting fixture that does not <br />exceed 1,500 lumens when the light is directed within the boundaries of the development site.” The proposed <br />lighting has 1124 lumens.
