<br /> <br />After recording return to: <br />Derrick Roser <br />1094 S. 11th St.. <br />Harrisburg, OR 97446 <br /> <br /> <br /> <br /> <br /> <br />22’ WIDE PRIVATE ACCESS EASEMENT. 19’ WIDE PRIVATE UTILITY EASEMENT, PRIVATE <br />DRAINAGE EASEMENT AND MAINTENANCE AGREEMENT <br /> <br />RECITALS: <br />Derrick Roser is the owner of a certain real properties, described as Parcels 1 & 2 of Partition Plat No. <br />____________________ as platted and recorded as Document No. 2026-________________________ <br />Records of Lane County, Oregon. <br /> <br />DECLARATION OF EASEMENT: <br />1. Easement Description. Derrick has created a 22’ wide private access easement, a 19’ wide <br />private utility easement across Parcels 1 & 2 for the benefit of Parcels 1 & 2 and a private <br />drainage easement on Parcel 2 for the benefit of Parcels 1 & 2 as shown on the said Partition <br />Plat. <br />2. Easement Created. The easements are created to allow private access and private utilities <br />including a stormwater treatment facility located on Parcel 2. <br />3. Use of Burdened Property. The owners or occupiers of the Parcels affected by the easement <br />shall have the right to use their property, including the area described as the easement, for any <br />purpose as long as the owners or occupiers do not interfere with the use of the easement as <br />granted by this instrument. <br />4. Maintenance and Repairs. The cost of any maintenance or repair of the area within the <br />easements, including the stormwater facility, shall be apportioned equally to the owners of <br />Parcels 1 & 2. Maintenance to be administered by all owners or by one Parcel owner as mutually <br />agreed. <br />5. Successors in Interest.
