Page 4 <br />(5) If a partition tentative plan application is not reviewed concurrently with a tentative PUD <br />application, no development permit shall be issued by the city prior to approval of the tentative <br />partition application. If a tentative partition is reviewed concurrently with a tentative PUD <br />application, no development permit shall be issued by the city prior to approval of the final PUD <br />application in accordance with EC 9.8305. <br />Applicant Response: Building Permit #26-00768-01 was submitted on February 13, 2026, for a new <br />commercial building on proposed Parcel 1. This proposed commercial building complies with the <br />applicable BDC standards in the current parcel configuration and will continue to comply with the <br />applicable BDC standards under the parcel configuration proposed in this Minor Partition application. <br />Accordingly, the Applicant understands that the proposed Minor Partition will not restrict the City’s <br />ability to review and issue Building Permit #26-00768-01. Applicant does not intend to seek any other <br />development permit prior to approval of this tentative partition application. <br />EC 9.8210, Partition, Tentative Plan Application Requirements <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements apply to <br />partition tentative plan applications: <br />(1) Applications are prepared by an Oregon licensed land surveyor and contain a preliminary title <br />report. <br />Applicant Response: An Oregon licensed land surveyor, David Schlosser Jr., prepared the tentative <br />partition plan and a preliminary title report has been included with the application materials. <br />(2) Applications include all contiguous property under the same ownership as the subject property <br />and are signed by the owner of the property. <br />Applicant Response: The tentative partition plan includes all contiguous property under the same <br />ownership as the subject property, and the application has been signed by a representative of <br />Macerich Valley River Center LLC, the property owner. <br />(3) The lot proposed to be divided in the partition application is a legal lot. <br />Applicant Response: The subject property is a legal lot, as determined by the Eugene Planning <br />Director in the approval of Casefile LV 25-01 issued on April 28, 2025. <br />(4) If the proposal includes housing, the written statement submitted with the partition application <br />shall clearly state whether the applicant is electing to use the discretionary approval criteria in EC <br />9.8215 Partition, Tentative Plan Approval Criteria – General/Discretionary instead of the approval <br />criteria found in EC 9.8220 Partition, Tentative Plan Approval Criteria – Housing/Clear and <br />Objective. <br />Applicant Response: The Project does not include any housing and the Applicant is using the <br />discretionary approval criteria in EC 9.815. <br />(5) The written statement submitted with the partition application shall clearly state whether the <br />applicant believes that the proposal qualifies for the expedited land division procedures in <br />EC9.7900 through EC 9.7925, and whether the applicant is electing to use the expedited land <br />division procedures in EC 9.7900 through EC 9.7925. <br />Applicant Response: As noted in this consistency memo, above, the Applicant understands that the <br />Project does not qualify for and is not electing to use the expedited land division procedures.
