Willagillespie Road Property Line Adjustment Page 4 of 6 <br />Property Line Adjustment: Written Statement <br />June 24, 2026 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />Written Statement <br />Introduction and Background <br />This Property Line Adjustment application involves 1 tax lot: Tax Lot 100 and 401. Tax Lot 100 is comprised of an <br />east portion, a west portion and a middle portion. The east portion and the west portion are legal lots (see attached <br />LLV 26-04). The middle portion was originally part of the property to the south (TL 401). An improper transfer of land <br />rendered TL 401 and the middle portion of TL 100 unlawfully created units of land. This Property Line application is <br />submitted to correct that error. <br /> <br />EC 9.8405 Applicability of Property Line Adjustment Applications. <br />(1) A property line adjustment application is applicable to changes to the property lines of adjoining <br />properties when all of the following exist: <br />(a) A property line proposed for adjustment will not result in an increase in the number of parcels or <br />lots. <br />This adjustment involves 2 units of land. When the process is complete there will still be 2 units of <br />land. <br /> <br />(b) A property line proposed for adjustment will not create more than 2 property line adjustments to <br />any of the boundaries of an individual lot or parcel within a calendar year. <br />This is the first adjustment that will be taking place between the 2 lots in 2026. <br /> <br />(c) The adjustment will result in less than a 200% change in the size of the lot or parcel. <br />This adjustment results in a change in area as follows. <br /> <br />Property 1 (TL 100) Existing: 11,822 sf <br />(a portion of that TL) Proposed: 17,421 sf <br /> Change: 47.4 % <br /> <br />Property 2 (TL 401) Existing: 12,939 sf <br /> Proposed: 7,340 sf <br /> Change: 43.3 % <br />(2) A property line adjustment may not be utilized to affect the reconfiguration of lots or parcels which <br />must be approved through the partition or subdivision procedure. <br />Under the current city land use code this adjustment does not result in a reconfiguration as defined by <br />the City of Eugene. <br />(3) A property line adjustment application may not be utilized to create flag lots. <br />This property line adjustment does not create a flag lot. <br /> <br />EC 9.8415 Property Line Adjustment Approval Criteria. The planning director shall approve, approve with <br />conditions, or deny the property line adjustment application. Approval or approval with conditions shall be <br />based on compliance with the following criteria: <br />(1) Any buildings to be retained on the properties comply with the minimum front and interior yard <br />setbacks as defined in this land use code. <br />There are 5 existing buildings on a portion of Tax Lot 100 that is involved in the Property Line <br />Adjustment application and Tax Lot 401. <br />All buildings will be retained. <br /> <br />EC Table 9.2750 Residential Zone Development Standards <br /> <br />Both properties abut properties zoned R-1 <br /> <br />Building Setback <br />Minimum Front Yard Setback 10 feet <br />Minimum setback for garage 18 feet <br />
