EC 7.420 Access Connections – Location. <br />(1) Access Connections to all Street Classifications. Access connections to all street classifications shall belocated in accordance with the following standards:a) No access connection shall be located to encompass a municipal utility. An access connection mayencompass a municipal utility if the applicant either: <br />No proposed access connections are located to encompass a municipal utility. This criterion does not apply. <br />b) Except when an existing lot or parcel frontage is located entirely within an area where the adjacentstreet grade is over fifteen percent (15%), no access connection shall be located in areas where thestreet grade is over fifteen percent (15%). If an existing lot or parcel frontage is located entirely within anarea where the existing street grade is over fifteen percent (15%), one access connection may bepermitted at the point of lowest grade percentage. <br />The subject property is not located on a street with a slope that exceeds 15% grade. This criterion is not applicable. <br />c) If a parcel has frontage on two or more streets of different street classifications, the accessconnection shall access the street with the lowest classification. The access connection can access thestreet with the higher classification if the applicant can demonstrate (1), (2) or (3): <br />Both abutting streets are local streets, this criterion is not applicable to this proposal. <br />d) Access connections located within five feet of an existing alley connection may be merged with the alleypavement. The combined connection width shall not exceed 35 feet. A public access easement shall be recordedand submitted to the city upon issuance of a permit to construct the access connection. <br />There are no alleys adjacent to the subject property which would require an access connection to be merged with thealley. This criterion is not applicable. <br />(2) Access Connections to Arterial and Major Collector Streets. In addition to the standards set forth in this EC7.420(1), access connections to arterial and major collector streets shall be located in accordance with thefollowing standards. <br />The subject property is not located on an Arterial or Major Collector Street; the criteria contained in Subsection (2) is notapplicable. <br />3) Access Connections to Local and Neighborhood Collector Streets. In addition to the location standards setforth in EC 7.420(1), access connections to local and neighborhood collector streets shall be located inaccordance with the following standards:a) Lots and parcels at intersections shall have the access connection begin no less than 20 feet from theend of the radius of the curb, or 20 feet from the property corner if there is no curb. <br />The subject property is not located at an intersection; subsection (a) above is not applicable. <br />b) A safety island of not less than 22 feet of full height curb shall in all cases be provided betweenaccess connections under one ownership. <br />The Variable Width Shared Access Easement is proposed for use by the new middle housing lots; access connectionstandards do not apply to a private driveway easement. A safety island is not required for this proposal. <br />EC 9.8194 Middle Housing Land Division, Tentative Plan Approval Criteria.(2) If the property to be divided is developed with middle housing:a) The middle housing complies with EC 9.5550; orb) The certificate of occupancy for the middle housing was issued before June 30, 2022, and the middlehousing complied with applicable land use requirements at the time the certificate of occupancy wasissued. <br />The subject property contains no existing middle housing; this criterion is not applicable. <br />(3) The proposed middle housing land division complies with all of the following:
