Response: <br />The property owner, Edwin Parsons Brock Jaffarian, has signed the application <br />materials. This criterion is satisfied. <br />EC 9.8193(5) - Legal Lot <br />Criterion / Standard: <br />The property to be divided must be a legal lot. <br />Response: <br />The subject property is a legal lot as defined by EC 9.0500. Legal lot status is <br />documented by Golden Gardens Subdivision identified as Lot 11, Block 2, <br />recorded 1949 in Lane County Official Records as Book 14 Page 26. The subject <br />property was created by statutory plat. This criterion is satisfied. <br />IV. Middle Housing Land Division Tentative Plan Approval Criteria <br />EC 9.8194 - Middle Housing Land Division, Tentative Plan Approval Criteria <br />EC 9.8194(1) - Property Not Yet Developed With Middle Housing <br />Criterion / Standard: <br />If the property is not yet developed with middle housing, the application must <br />propose development of middle housing on the lot or parcel, and the lot or parcel <br />must be developable with middle housing consistent with EC 9.2750, 9.2751, <br />9.2760, 9.2761, 9.2775, and 9.5550. <br />Response: <br />The subject property is not yet developed with middle housing. The application <br />proposes future development of a duplex on the parent lot. The parent lot is <br />developable with a duplex because duplex middle housing is allowed on the <br />subject property and the parent lot can comply with the applicable residential lot <br />standards, middle housing development standards, access, utility, and building <br />code requirements. <br />
