(b) In the Tree Top Special Historic zone, the maximum building height for a duplex, triplex, or <br />fourplex, is 30 feet, plus the allowance for additional height provided in subparagraph (a) <br />above. <br />(c) Non-Conforming Height of Tree Top Historic Home: This section applies to legally existing <br />structure within the Tree Top Special Historic Zone (the Home) that exceeds the maximum <br />height otherwise permitted by this Code. Therefore: <br /> <br />1. A structure that was lawfully established and exceeds the 30 feet maximum height limit <br />(the main house of the Tree Top Historic Home) shall be deemed a legal <br />nonconforming structure with respect to height. <br />2. The existing height of such existing structure, including a structure measuring up to 43 <br />feet, may be maintained. <br />3. A legal nonconforming structure may be repaired, restored, reconstructed, or <br />replaced in the event of damage or destruction caused by natural or man-made events, <br />including but not limited to flre, storm, or other casualty. <br />4. Such repair, restoration, or reconstruction may occur to the original height and bulk of <br />the structure as it existed prior to damage or destruction. <br />5. Reconstruction shall not be required to conform to current height limits, provided that <br />the height does not exceed the previously existing lawful height. <br />6. A legal nonconforming structure may be remodeled or redesigned, provided that: <br />a. The structure does not exceed its previously existing lawful height; and <br />b. Any increase in nonconformity beyond the original height is prohibited. <br /> <br />(15) Driveways and Parking Areas. <br />(a) In the Tree Top Special Historic zone, driveways and associated parking spaces shall be <br />hard-surfaced with asphalt, concrete, pavers or grass-crete. No parking shall be allowed <br />outside of the hard-surfaced area. <br />(b) In the Tree Top Special Historic zone, Middle Housing. The standards in subparagraph (a) <br />above do not apply to duplexes or to development subject to the Middle Housing <br />Development Standards at EC 9.5550. <br /> <br />(16) Accessory Buildings in the Tree Top Special Historic zone. <br />(a) General Standards. The following standards apply to all new accessory buildings: <br />1. Building Size. The maximum square footage of all accessory buildings shall not exceed <br />10 percent of the lot area. For the purposes of calculating square footage, all fioors of a <br />multi-story structure shall be included. <br />2. Building Height/Interior Setback. <br />a. Interior yard setbacks shall be at least 5 feet.
