Broadway <br />Eugene, OR 97402 <br />Subject: Zone Verification — City File # ZVR 16-29 <br />Location: 1548 Chambers Alley, Eugene, OR <br />Assessor's Map # 17-04-36-34, Tax lot # 05300 <br />Dear Ms. Cunningham & Mx. Sherman, <br />I am writing in response to your request received June 15, 2016 regarding the aforementioned property. <br />The property is zoned R-1 (Low Density Residential) which is governed under Eugene Code (EC) 9.2700 <br />for uses and development standards. There is no overlay zone on this property. The Eugene Code, <br />including Land Use Chapter 9, is available online at: http://www.eu.ene-or.gov/citycode. As part of our <br />response to your request for zoning information, we did not perform a site inspection. <br />The development site consists of 1740 West 151 Avenue and 1548 Chambers Alley, located on tax lot <br />5300, which contains two separate single family dwellings. The results of a building permit research <br />request shows that a permit was obtained in 1967 to construct a detached garage and storage building, As <br />well as two letters addressing a use violation of the detached accessory structure. The first letter was from <br />the City, dated November 18, 1976, confirming that a conversion of the garage had occurred without the <br />benefit of permits and was a violation of the zoning regulations at the time. The second letter was from an <br />attorney, dated June 23, 1977, who was representing the buyer of the property and was seeking relief from <br />the violations through Lane County Circuit Court, based on the premise that the property was sold while <br />in violation. Unfortunately there was no information found on the outcome of the trial or follow up <br />enforcement. Therefore, the City is choosing to treat the dwelling at 1548 Chambers Alley as if it has <br />legal non -conforming status and continuation of the use is allowed subject to the standards at EC 9.1220 <br />Legal Nonconforming Use. <br />Please note this zone verification will be made available to the public and provided to interested parties, <br />as well as being documented within the City's permit tracking system, in accordance with statutory <br />requirements at ORS 227.175(11). Furthermore, this verification is a final determination at the local level <br />and therefore may be appealed to the Land Use Board of Appeals, in accordance with statutory provisions <br />beginning at ORS 197.835. <br />Please contact Randy Sangder at 541-682-8328 or randy.c.sangder@ci.eugene.or.us for any questions <br />related to the zoning code violation on the subject property.
