FINAL MIDDLE HOUSING LAND DIVISION PARTITION APPROVAL <br />GRAHAM WELCOME WAY (MHT 25-38) <br /> Metro Planning, Inc. March 2026 P a g e | 3 <br /> <br />1. The applicant shall submit an Irrevocable Petition for public improvements within Welcome <br />Way to include street trees. <br />A DRAFT Irrevocable Petition is submitted with this application packet. <br />2. Prior to final middle housing approval, the applicant shall submit documentation <br />demonstrating whether the accessory structure remains on the subject property. If the <br />accessory structure remains, the existing structure shall be removed or move to ensure no <br />non-conforming situation is created. Alternatively, a deed restriction shall be recorded to <br />prohibit the use of the structure until a development permit for middle housing unit has been <br />issued for Parcel 3. <br />The accessory structure has been removed as part of the Approval Conditions in LA 25-14, picture is <br />attached showing the structure gone. <br />3. Prior to final middle housing approval, the applicant will provide an updated site plan <br />specifying the beneficiaries of the existing 5-foot utility easement and the proposed 5-foot <br />utility easement (public, private, EWEB). <br />The beneficiary of existing 5-foot utility easement is EWEB, and the proposed 5-foot utility easement is <br />Private, as shown in the final plat and final site plan. <br />4. Prior to final middle housing approval, the applicant will provide evidence that separate <br />electrical service is outside the bounds of Middle Housing Lots (Parcels) 1, 2, and 3; or an <br />EWEB easement may be provided to serve Middle Housing Lots (Parcels) 1, 2, and 3. <br />Alternatively, the applicant may provide a deed restriction that holds the proposed parcels <br />under common ownership as one development site until such time as either separate electrical <br />service has been provided to Middle Housing Lots (Parcel) 1, 2, and 3 or that an EWEB <br />easement has been provided and utilities are located in the easement. <br />There is an existing 5-foot utility easement for the benefit of EWEB located along the east line of all <br />lots/parcels as shown in the final plat and site plan. <br />5.
