The <br />applicable Code sections and text are listed followed by the Applicant's response. <br />EC 9.8210, Partition, Tentative Plan Application Reauirements <br />Applications shall be submitted on a form approved by the city manager, be accompanied by a fee <br />established pursuant to EC Chapter 2, and be signed by the property owner, unless the applicant is a <br />public agency, in which case the signature of the property owner is not required. Application materials <br />shall address each of the criteria and standards applicable to the proposed use including any requested <br />adjustments to standards as provided in provisions beginning at EC 9,8015. For applications described at <br />EC 9.7007(1), the application shall include the following materials related to the neighborhood/applicant <br />meeting. <br />Applicant Response: The application packet includes a completed and signed application form, is <br />accompanied by the required processing fee, and this consistency memo details the Project's <br />compliance with the relevant criteria and standards applicable to the proposed Minor Partition - <br />Tentative. The Project does not make any adjustments to the relevant standards. The Project does <br />not require a neighborhood/applicant meeting, pursuant to EC 9.7007, therefore the application is not <br />required to include the associated meeting materials listed in Subsections (1) through (4) in this <br />Section. <br />EC 9.8205, Applicability of Partition. Tentative Plan Applications <br />(1) Except as provided in subsections (2) and (3) of this section, requests to create 2 or 3 parcels <br />shaft be subject to the partition provisions of this land use code, and shall follow a Type If <br />application procedure. <br />Applicant Response: The Project is a request to create three (3) parcels and this consistency memo <br />is intended to support the Applicant's request for approval through the Type II procedure, in <br />accordance with the provisions in this Section. <br />(2) Partition applications that meet the approval criteria in EC 9.8215(7) or EC 9.8220(5) may be <br />processed pursuant to the expedited land division procedures in EC 9.7900 through EC 9.7925. <br />Applicant Response: The subject property is not within a residential zoning district and the resultant <br />parcels are for commercial use; therefore, this partition application does not meet the approval criteria <br />in EC 9.8215(7) or EC 9.8220(5) and does not qualify for expedited land division procedures. <br />(3) Concurrent applications may be processed as provided in EC 9.6005. <br />Applicant Response: This application is for a Minor Partition - Tentative only and does not include <br />any concurrent applications. <br />(4) A tentative plan application to partition land may be submitted and reviewed concurrently with a <br />tentative PUD application following a Type 111 application procedure. If a partition application that <br />also involves a PUD application is not submitted concurrently with the tentative PUD application, <br />the partition application may not be submitted until a tentative PUD is approved. (Refer to EC <br />9.8305 Applicability.) <br />Applicant Response: This application is for a Minor Partition - Tentative only and does not include <br />any concurrent applications. <br />
