• Concerns with shared driveways with and cars parked in a single driveway, the Joint <br />Access & Maintenance Agreement (JAM) for the shared driveways, the variable widths <br />and the maintenance responsibilities. The driveways that are too narrow for <br />emergency vehicle access and is a risk to public safety. <br />Section 2 of this decision provides full analysis of how this final PUD application is in <br />conformance with each of the above listed conditions of approval of the tentative PUD. The <br />findings for Condition of Approval 5 regarding the JAM include an additional condition for <br />compliance prior to final site plan approval. The Fire Marshal's Office has reviewed the plans <br />and provided referral comments, which did not express concerns with the driveway widths or <br />indicate a risk to public safety. These referral comments are included in the record materials. <br />Further, as this proposal is the finalization of the previously approved PUD, this proposal will <br />not generally add any additional or new concerns related to this topic that were not previously <br />argued during the Tentative PUD process. <br />• Compliance with the required 25-foot buffer established at EC 9.4920(2)(b) has not <br />been clearly demonstrated. EC 9.4920(3) Combined conservation footprint for wetland <br />and stream Natural resource identification requirements under the /WR Overlay. <br />No development is currently proposed within the Conservation Area identified above that is not <br />already being considered as part of this Standards Review application. Other development, such <br />as the development of individual lots over time will be required to demonstrate compliance <br />with the applicable setbacks for protected riparian resources located through the development <br />site. This approval process does include any approval criteria that would warrant or otherwise <br />mandate the mapping of the 25-foot buffer as part of this specific process. <br />• Violates Eugene Code 9.4930(3)(e)(3), which requires that all excavated areas be <br />backfilled with existing native soil. <br />This code section applies to new underground utility lines within conservation areas and <br />requires backfilling to the existing grade with native soil to minimize the impact to the <br />conservation area. However, EC 9.4930(3)(b) allows for the construction of public streets and <br />public utilities subject to the standards at EC 9.4980, which are addressed in Section 1 of this <br />Decision, therefore EC 9.4930(3)(e)(3) would not be applicable. <br />• Did not adequately identify wetlands within 50 feet of property lines. <br />All known, existing wetlands are shown on the plans and in relation to proposed lot lines. Most <br />of the wetlands on the site are listed as unprotected. The only wetland identified for protection <br />exists in the same area as the protected Videra stream.
