The project area spans a small section of the resource in the southwest <br />portion of the property. <br />Specifically, the project is within the area of Upland Resource E35 A and Wetland Resource <br />AMA-513. Videra Creek is a Category B stream. While the protected creek crosses the entire <br />property in the southern portion of the site, the scale of impact within the conservation area is <br />limited to approximately 1,105 square feet of disturbance. <br />In accordance with Eugene Code Sections (EC) 9.4930(2)(c), the removal of non-native and <br />invasive plants and the planting of native plants are an allowed use. In accordance with EC <br />9.4930(3)(b), the construction of public streets is subject to a Standards Review (EC 9.8460 — <br />9.8472) and the standards at EC 9.4980 /WR Water Resources Conservation Overlay Zone <br />Development Standards (1) through (11). While there are other protected resources within the <br />remainder of the subject property, at this time, the only activity that requires a Standards <br />Review is the construction of Randy Lane. All other protected riparian and wetland resources <br />will be protected and reviewed with individual development applications over time. <br />Additional details of the proposal are included in the applicant's written statement, on <br />proposed site plans and in other supporting documentation, all of which are included as part of <br />the public record and located in the application file for reference. <br />Procedure, Public Notice, and Agency Referrals <br />Application Submitted September 5,. 2025 <br />Application Complete <br />Public notice of the subject application was mailed in accordance with EC 9.7210. Twenty-two <br />concerned citizens submitted testimony during the public comment period, all of which are <br />available in the file record for reference. Many of the comments submitted shared the same or <br />very similar concerns regarding several key issues. The following testimony summary and <br />review will focus on the general topics of concern or application deficiency as expressed <br />throughout the various testimonies received rather than a review of each individual piece of <br />testimony. Testimony concerns, questions or statements of application deficiencies will be <br />listed in bold font and staff analysis will be in regular font. <br />• Increased traffic and limited ability for emergency services response. <br />Eugene Springfield Fire Marshal's Office reviewed the proposed plans for both this current <br />application and the approved tentative planned unit development (PUD) and tentative <br />subdivision (City File # PDT 24-1 and ST 24-3) and expressed no concerns related to emergency <br />service access to the site. Fire Marshal's Office comments dated February 25, 2026 (included as <br />Attachment A), will require "No parking -Fire Lane" signage on both sides of the private streets <br />in the development to ensure adequate widths for emergency vehicular movements within the <br />March 2026 Findings & Decision of the Planning Director Page 2 of 28 <br />Braewood Hills Third Addition (SDR 25-02 & PDF 25-01) <br />
