within the 90-day timeline, a request for an extension will be submitted to the Planning <br />Director. To ensure this standard I met, the following condition is warranted: <br />4. Prior to Final PUD approval, the following note shall be added to the final site plans: <br />"Any disturbed areas within the Conservation Setback shall be replanted within 90 days <br />of any clearing or vegetation removal activities, unless otherwise approved by the <br />Eugene Planning Director." <br />Based on the above findings and condition of approval, this standard will be met. <br />(e) Plantings shall not adversely affect adjacent protected water resources or existing <br />native vegetation through shading or invasion by plant species introduced into the <br />setback. <br />The applicant's statement indicates that the selected plant species will enhance the area by <br />replacing non-native plants with native plants and will not adversely impact the water resource. <br />With the condition suggested above at EC 9.4980(3)(a) for a revised planting list, incorporated <br />herein by reference, the applicant's proposal will comply with the standard above due to the <br />existing methodology for selecting plants provided by the City's adopted Goal 5 native plant list <br />Based on the materials in the record and the above findings and conditions of approval, the <br />standards at EC 9.4980(3) are met. <br />(4) Construction Practices. Construction within the /WR conservation area, and within <br />areas removed from the /WR conservation area shall comply with the following <br />standards: <br />(a) For purposes of this subsection, heavy machinery is defined as motorized or <br />mechanized machinery or equipment capable of deliberately or inadvertently <br />damaging vegetation, or damaging or compacting soil. The following standards <br />shall apply to use of heavy machinery within the /WR conservation area: <br />1. On sites where soils are susceptible to severe compaction or structural damage <br />when wet or saturated, use of heavy machinery shall be limited to the period <br />between June 15 and September 30, unless otherwise approved by the <br />planning director. <br />2. Use of heavy machinery shall be the minimum necessary for the use or activity <br />and shall be restricted to those areas where its use is necessary. <br />The applicant states that machinery, tools, supplies and other construction materials will not be <br />stockpiled or stored in the /WR conservation areas. The applicant states that machinery use will <br />be limited to the period between June 15 and September 30 and be the minimum necessary to <br />complete construction. <br />The applicant's site plans show an area of construction within the protective setback and <br />includes protective fencing along the perimeter of the Conservation Area north of the road to <br />March 2026 Findings & Decision of the Planning Director Page 14 of 28 <br />Braewood Hills Third Addition (SDR 25-02 & PDF 25-01) <br />
