<br />Helikson MHF – Final Plan Page 6 of 7 <br />Written Statement March 5, 2026 <br /> <br /> <br /> <br />(5) All conditions of tentative middle housing land division approval have been <br />met and the final plat substantially conforms to the provisions of the approved <br />tentative middle housing land division. <br />As shown in PART III, below, all conditions of approval have been met and the attached <br />Final Plan substantially conforms to the provisions of the approved tentative middle <br />housing land division. <br /> <br />PART III – CONDITIONS OF APPROVAL COMPLIANCE <br /> <br />Part III addresses compliance with the Conditions of Approval associated with City of Eugene <br />Land Use File #MHT-24-18. Each applicable Condition of Approval is listed below in bold <br />italics followed by findings demonstrating compliance. <br /> <br />1. The applicant shall submit an Irrevocable Petition for public improvements in <br />Sunshine Acres Drive to include street trees. <br />The required Draft Irrevocable Petition is included as an attachment to this application. <br /> <br />2. Prior to final plat, the applicant will provide evidence that separate water service lines <br />are provided to Middle Housing Lots (Parcels) 1-3 within the bounds of each respective <br />lot. Alternatively, a reciprocal private utility easement may be provided from Middle <br />Housing Lots (Parcels) 1-3 for the benefit of Middle Housing Lots (Parcels) 1-3. <br />As noted on the Final Plat, a 5’ private water easement is provided across Parcel 1 for the <br />benefit of Parcel 2. Both Parcel 2 and Parcel 1 have sufficient access to the existing water <br />system in Sunshine Acres Dr. However, an additional 10’ EWEB easement is provided across <br />Parcel 3 in compliance with this condition. <br /> <br />3. Prior to final plat, and to achieve compliance with EC 9.8194(4)(b), the following <br />options are available: (1) the applicant shall provide documentation demonstrating the <br />private wastewater for Parcel 1 has been relocated into a private utility easement; or (2) <br />the applicant shall submit a deed restriction holding Middle Housing Lots (Parcels) 1-3 in <br />common ownership as a single development site until the requirements and recorded <br />easements are provided to the city as required under option (1) above. <br />A private utility easement is shown on the Final Plat benefiting Parcel 1 and Parcel 2 in <br />compliance with this criterion. <br /> <br />4. On the final plat, the applicant shall include provisions for pedestrian ingress/egress in <br />the proposed variable width private access easement and utility easement. <br />Pedestrian easements have been provided from Lots 2 and 3 to Sunshine Acres in compliance <br />with this condition and are cross referenced on the Plan. <br />
