2/20/2026

4
The Applicant responds: “Acknowledged and agreed.” Standards Review Application, p. 11.
Such a broad and vague assertion without supporting evidence is insufficient to demonstrate compliance
with the Code provision. “Acknowledged and agreed” does not indicate the methodologies to be utilized that
will ensure that no petroleum products, chemicals, or other deleterious materials used in the construction
process are allowed to enter the stream and wetland on the subject property.
Therefore, the Applicant has not carried their burden of proof and demonstrated compliance with
EC 9.4980(4).
III. Conclusion

For the above reasons, Save Videra Oak Meadows and Wes Van Winkle requests that the final PUD and
the standards review applications, File Nos. PDT 25-01/ST 25-02, be denied.

Respectfully submitted,
Charles W. Woodward, IV
Attorney for Save Videra Oak Meadows and Wes Van Winkle
