2/20/2026 <br /> <br />4 <br />The Applicant responds: “Acknowledged and agreed.” Standards Review Application, p. 11. <br />Such a broad and vague assertion without supporting evidence is insufficient to demonstrate compliance <br />with the Code provision. “Acknowledged and agreed” does not indicate the methodologies to be utilized that <br />will ensure that no petroleum products, chemicals, or other deleterious materials used in the construction <br />process are allowed to enter the stream and wetland on the subject property. <br />Therefore, the Applicant has not carried their burden of proof and demonstrated compliance with <br />EC 9.4980(4). <br />III. Conclusion <br /> <br />For the above reasons, Save Videra Oak Meadows and Wes Van Winkle requests that the final PUD and <br />the standards review applications, File Nos.
