conservation setback, and the proposal therefore fails to conform to section <br />9.4920(2)(b). <br />The Goal 5 stream also has its own separate setback requirement. EC <br />section 9.4920, subdivision (3) states as follows: <br />"To determine the /WR conservation area for sites in which wetlands exist <br />along with either an upland wildlife habitat site or a riparian site, the /WR <br />conservation area for each of the individual water features shall be <br />calculated and mapped separately, and the total footprint of all the <br />individual /WR conservation areas combined shall be the /WR conservation <br />area for that site." <br />The wetlands in question include the Goal 5 stream, which is classified as a <br />Category C stream for purposes of section 9.4920. (See Goal 5 Water <br />Resources Conservation Plan, Section IV, Map 7.) Therefore, the <br />conservation area for the wetlands and the stream must be calculated and <br />mapped separately, and the total footprint of the combined /WR <br />conservation areas for the wetlands and the stream constitute the /WR <br />conservation area for the site. Under section 9.4920, the wetlands require a <br />setback of 25 feet, and the Category C stream requires a setback of 40 feet. <br />However, it does not appear from the application that the conservation area <br />for the wetlands was ever calculated or mapped at all, and thus the <br />combined /WR conservation area for the site has not been determined. It <br />seems clear that the combined setback will be greater in places than the <br />setbacks currently shown on the site plan. For example, the application <br />materials fail to include, or provide wetlands setbacks for, wetlands in Lots <br />32 and 27 where a portion of the site map continues to represent parts of <br />Wetlands 2 as being removed when more recent maps show them being <br />retained even if the permit is granted. (The area in question can be seen on <br />map on page 31 of the application Materials-SDR.pdf (i.e., the second page <br />of the attached maps at the end of the document) as the blue area above and <br />attached to the wetlands and Goal 5 creek. Although the application site <br />plan for SDR 25-02 shows only a portion of the wetlands in Lot 32 will be <br />preserved, the applicant’s current maps show that the entire wetland area <br />attached to the creek in Lots 32 and 27 will be preserved.) The application is <br />therefore not complete and does not comply with section 9.4920(3).
