Learn why this is important <br />[EXTERNAL ] <br />To: Mr. Nick Gioello <br />From: Whitney Gould, whitneygould@yahoo.com, (510) 368-8941 <br />Subject: Comment on Final Application for Braewood Hills 3rd Addition <br />Requesting Application for FINAL Planned Unit Development (PDF 25-01) and Standards <br />Review (SDR 25-02) be DENIED. <br /> Introduction: <br /> The Applicant’s Final Planned Unit Development Proposal for Braewood Hills 3rd Addition <br />clearly shows the project will have disastrous environmental effects on the 15-acre parcel and <br />create considerable safety and liability risks for future residents of the property and residents <br />of the surrounding neighborhood. <br /> The Private Joint Use Access and Utility Easement and Maintenance Agreement (JAM,) <br />which was added to the application on January 21, 2026, and shared with concerned parties <br />on February 7, 2026, delineates some of the conditions that will contribute to these issues. <br /> <br />Code Violation <br /> Because the JAM presents, for the first time, details of the shared driveways, or “Joint <br />Access Easements,” their maintenance, maintenance costs, and the responsibilities of selected <br />homeowners, the Final Planned Unit Development Proposal violates Section 9.8365 of the <br />Eugene Code which states the “Final PUD plan conforms with the approved tentative PUD plan <br />and all the conditions attached.” Because of the new information, the document does not <br />conform. <br /> <br />EWEB Documentation Not Provided <br /> In violation of Eugene Planning Commission, Condition of Approval 11, EWEB <br />documentation of the JAM agreement has NOT been provided. The application materials are <br />insufficient to demonstrate compliance. <br />Issues Raised: <br />In an effort to cram as many homes as possible on the property, the developer’s plan <br />shows that a majority of the 37 buildable lots will have shared driveways, (aka “Joint Access
