EC 9.4980(4)(a) 1 & 2 <br />Soil in the development area is always saturated and, as a result, susceptible to severe <br />compaction. The application indicates that machinery, tools, supplies, and other <br />construction materials won’t be stockpiled or stored. Due to the susceptibility to <br />compaction, all machinery must be removed from the /WR conservation area each day. <br />EC 9.4980(4)(b) <br />The application does not state exactly what measures will be taken to ensure that <br />construction materials described in this code will be prevented from entering the stream or <br />wetland. <br />Due to the adjacency of the development to Eugene City Parks’ Videra Park, the application <br />should be required to state how Videra Park and its natural resources will be protected <br />from any incursion by machinery, products, or chemicals. <br />Other Videra Park concerns <br />Nearly 2/3 of the southern property line for the development is shared with Videra Park. <br />Actions taken during development near or on the property line can have an adverse eƯect <br />on the natural environment and resources of Videra Park. <br /> Either the developer or the City must provide a full survey and mapping of the <br />combined Wetland and Creek Conservation area for the portion of AMA 5B and <br />E35A in Videra Park to ensure conservation codes are met. <br /> All trees in Videra Park within 30 feet of the property line need to be identified and <br />mapped, along with their critical root zones, to ensure that native oak trees are not <br />negatively impacted by any proposed construction. <br /> The extension of Randy Lane, as well as the swales to the north of it, must be <br />prevented from denying critical water for the trees on the other side of the property <br />line in Videra Park. <br />Summary <br />This application does not appear to take Goal 5 requirements with respect to wetlands and <br />old-growth trees seriously. As a result, the application does not fulfill/address the Goal 5 <br />city codes enumerated above, and, as such, the application should be denied.
