651 West 23rd Avenue (MHT 25-36) Page 2 of 5 <br />Conditions of Approval <br />February 27, 2026 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />(4) Public assessment, and fees with respect to the partition have been paid, or: <br />(a) A segregation of assessments and liens have been applied for and granted by the <br />city, <br />(b) An adequate guarantee in a form acceptable to the city manager has been provided <br />assuring the liens, assessments and fees will be paid prior to recording the final plat. <br />There are no liens or fees associated with the partition. <br />(5) All conditions of tentative partition approval have been met and the final plat substantially <br />conforms to the provisions of the approved tentative partition. <br />All conditions of tentative partition approval have been met. See responses below and <br />Final Plat map. <br /> <br />Conditions of Approval <br />1. The applicant shall install the proposed 23rd Avenue sidewalk for the parent lot prior to issuance of a <br />certificate of occupancy for middle housing unit on the first Middle Housing Lot. <br />Uncertain why this wasn’t something that would have been part of building permit submittal and <br />review since the applicant can’t meet this condition of approval for Final Plat except to agree to it. <br /> <br />2. The applicant shall add the following note to the final site plan: “A sidewalk will be installed at the <br />expense of the property owner prior to issuance of a certificate of occupancy for any development of <br />middle housing on the subject property. The sidewalk shall comply with all applicable standards, and <br />any necessary permits for the construction of the sidewalk shall be obtained prior to construction.” <br />This note has been added to the Site Plan. <br /> <br />3. An Irrevocable Petition shall be provided with the final plat for public improvements in Jefferson Alley <br />to include adequate paving width and storm drainage. <br />See attached Irrevocable Petition. <br /> <br />4. The applicant shall dedicate a 1-foot-wide strip of right-of-way along the entire portion of the <br />development site that abuts Jefferson Alley, which will result in 7 feet of right-of-way on the west side <br />of the centerline. <br />A 1.5 -foot-wide strip of right-of-way has been dedicated along the entire portion of the development <br />site that abuts Jefferson Alley. The alley is actually 12.5 feet wide and the surveyor determined that <br />the east right of way line of the alley is fixed and in order to meet alley width requirements 1.5 feet <br />would need to be dedicated. <br /> <br />5. The applicant shall relocate the existing wastewater line serving Middle Housing Lot 3 into the <br />proposed private utility easement; or, record an easement over the existing wastewater line; or, <br />record a deed restriction to ensure that Middle Housing Lots 1, 2, and 3 will remain under common <br />ownership until the wastewater line has been relocated and any necessary easements have been <br />established. <br />See attached Deed Restriction. <br /> <br />6. The applicant shall relocate the existing electric line serving Middle Housing Lot 3 into the proposed <br />EWEB Easement; or, record an easement over the existing electric line; or, record a deed restriction <br />to ensure that Middle Housing Lots 1 and 3 will remain under common ownership until the electric <br />service has been relocated and any necessary easements have been established. <br />See attached Deed Restriction. For clarification the easement is a PUE not an EWEB Easement. <br /> <br />7. The applicant shall submit documentation that any structures that are located on both Middle Housing <br />Lots 1 and 2, or both Middle Housing Lots 2 and 3, have been moved or removed. Alternatively, the <br />applicant shall record a deed restriction holding the subject property under common ownership as a <br />single development site until such time that the structures are moved or removed, or the necessary <br />easements for shared building elements are provided. <br />See attached Deed Restriction. <br />
