Executive Summary <br />GSC Investments (Applicant) seeks to subdivide property in Eugene, Oregon. Under Eugene’s Land Use <br />Code, parcels must be established as lots of record to be subdivided. This lot validation application will <br />document and demonstrate that the subject parcel meets the code’s legal lot criteria, allowing the <br />subdivision to move forward. <br />This application includes the City application forms, written materials, and preliminary plans necessary for <br />City staff to review and determine compliance with the applicable approval criteria. The evidence is <br />substantial and supports the City’s approval of the application. <br />II. Site Description/Setting <br />The property (Tax Lot 5000 of Lane County Assessor’s Map 17043200) is south of Crow Road within the <br />Urban Growth Boundary (UGB) and is ±38.15 acres. The City’s UGB abuts the southern boundary; <br />therefore, properties to the south are outside the Eugene city limits but within the City of Eugene urban <br />reserves. <br />III. Background <br />A Public Record Report dated December 5, 2025, that documents ownership and conveyances of the <br />subject site was prepared by First American Title Company and is included in Exhibit C. Exhibit C also <br />includes copies of the deeds referenced in the Public Record Report. As documented in the Public Record <br />Report, the property was initially created by deed in January 1950 (Book 409, pages 302 and 303). Portions <br />of the property were subsequently conveyed by deed in 1963, 1967, 1976, and 1977, resulting in the <br />current configuration. A map illustrating the original property configuration and properties that were <br />separated by subsequent deeds is included in Exhibit D. As illustrated, Deed 7726274 (recorded on May <br />3, 1977) was the last deed that was recorded that changed the property’s configuration. <br />IV. Establishment of the Legal Lot <br />Pursuant to the provisions of 9.0500 found in the Eugene Land Use Code, a legal lot is a lot of record that <br />has boundary lines that were established by one of the following: <br />THE EUGENE CODE <br />Chapter 9 – Land Use <br />9.0500 Definitions. <br />Legal Lot. A lot of record that has boundary lines that were established: <br />(A) Through a partition or subdivision procedure, <br />(B) By a deed that was signed before April 2, 1962, or <br />(C) Through approval of an application to validate a unit of land consistent with <br />ORS 92.176. <br />Response: The underlying property was created in its current configuration by deed in 1977; <br />therefore, A or B cannot be used to demonstrate that it is a legal lot. Included with this <br />application are materials that validate the land consistent with Oregon Revised Statutes <br />(ORS) 92.176.
