The Council therefore interprets <br />the changed circumstances criterion in EC 9.8424(2)(d) to allow amendment of the plan given <br />the time that has passed since the plan was last updated. <br />In sum, the Refinement Plan Amendment addresses EC 9.8424(2)(c), (d) and (e) and therefore <br />complies with EC 9.8424(2). Based on the above findings, this criterion is met. <br /> <br />CODE AMENDMENT <br />Application details <br />As stated at EC 9.4200, the purpose of the /EC East Campus Overlay Zone is to provide for a <br />land use transition between the eastern portion of the University of Oregon campus and the <br />adjacent low-density residential neighborhood to the east and south. As one of the codified <br />provisions intended to meet this purpose, the Land Use Code sections pertaining to the /EC East <br />Campus Overlay Zone includes requirements related to allowed and prohibited uses. Eugene <br />Code (EC) Section 9.4215(1)(c) establishes that “University and college dormitories” are a <br />prohibited use in the /EC Overlay Zone. The land use transition is also implemented through the <br />requirement at EC 9.4220(2), which requires that, “Within the /EC East Campus Overlay Zone, a <br />building within 60 feet of an R-1 Low Density Residential zone shall not exceed 30 feet in height. <br />All other buildings shall not exceed 45 feet in height.” <br />The University of Oregon has identified a need for increased development potential of on- <br />campus student housing in the East Campus area. To meet this need, the University has <br />proposed changes to the Refinement Plan and the Land Use Code to allow development of <br />student dormitories on properties zoned with the /EC East Campus Overlay Zone. <br />The Land Use Code Amendment will increase the allowed building height within the /EC East <br />Campus Overlay Zone from 45 feet to 85 feet; to expand the “residential transition” distance <br />from R-1 zoned properties from 60 feet to 75 feet; and to increase the allowed building height <br />within the residential transition area from 30 feet to 45 feet. <br />Evaluation – Code Amendment <br />The following findings address the applicable approval criteria for the requested Code <br />Amendment: <br />EC 9.8065(1) Is consistent with applicable statewide planning goals as adopted by the <br />Land Conservation and Development Commission. <br />Goal 1: Citizen Involvement - To develop a citizen involvement program that <br />ensures the opportunity for citizens to be involved in all phases of the planning <br />process. <br />Council finds that the procedure followed by the City in this consolidated application is <br />consistent with Goal 1 for the reasons described above in the Council’s findings regarding the <br />refinement plan amendment process.
