Decision <br />Based on the available information, evidence, and preceding findings of compliance with <br />applicable approval criteria and standards, the Tentative Middle Housing Land Division is <br />APPROVED subject to the following conditions: <br />1. The applicant shall submit an Irrevocable Petition for public improvements in Jackson <br />Street to include sidewalks. <br />2. The applicant shall submit an Irrevocable Petition for public improvements in Adams Alley <br />to include adequate paving width and storm drainage. <br />3. The applicant shall denote the pedestrian access easement connecting Lots (Parcels) 2 and <br />3 as the primary access for Lots (Parcels) 2 and 3 on the final site plans and include the <br />following note to the final site plans, "Prior to issuance of a certificate of occupancy for the <br />future dwelling on Lots (Parcels) 2 and 3, the pedestrian connection between Lots (Parcels) 2 <br />and 3 and Jackson Street shall be improved (e.g. paving, pavers, or similar improved hard <br />walking surface), establishing the pedestrian connection as the primary access and the alley as <br />secondary access." <br />4. Prior to final plat approval, the applicant will provide evidence that a separate water <br />service line is provided to Middle Housing Lots (Parcels) 2 and 3 outside the bounds of Middle <br />Housing Lot (Parcel) 1; or a private utility easement may be provided from Middle Housing Lot <br />(Parcel) 1 for the benefit of Middle Housing Lots (Parcels) 2 and 3. Alternatively, the applicant <br />may provide a deed restriction that holds the proposed parcels under common ownership as <br />one development site until such time as either the separate water service line has been <br />provided to Middle Housing Lots (Parcels) 2 and 3 are outside the bounds of Middle Housing Lot <br />(Parcel) 1, or that a private utility easement has been provided and utilities located in the <br />easement. <br />5. Prior to final plat approval, the applicant will provide evidence that a separate wastewater <br />service line is provided to Middle Housing Lot (Parcel) 1, outside the bounds of Middle Housing <br />Lots (Parcels) 2 and 3; or a private utility easement may be provided from Middle Housing Lots <br />(Parcel) 2 and 3. Alternatively, the applicant may provide a deed restriction that holds the <br />proposed parcels under common ownership as one development site until such time as either <br />the separate wastewater service line has been provided to Middle Housing Lot (Parcel) 1, or <br />that a private utility easement has been provided and utilities located in the easement. <br />6. Prior to final plat approval, the applicant will provide evidence that separate electrical <br />service is outside the bounds of Middle Housing Lots (Parcels) 2 and 3; or an EWEB easement <br />may be provided to serve Middle Housing Lots (Parcels) 1, 2 and 3. Alternatively, the applicant <br />may provide a deed restriction that holds the proposed parcels under common ownership as <br />one development site until such time as either separate electrical service has been provided to <br />Middle Housing Lots (Parcels) 1, 2 and 3, or that an EWEB easement has been provided and <br />utilities located in the easement. <br />7. On the final plat, the applicant shall include provisions for pedestrian ingress/egress in the <br />proposed 5 foot wide utility and access easement. Proposed Middle Housing Lots (Parcels) 2 <br />and 3 will not have frontage on a street, but they will have access to Jackson Street via a 5 foot <br />public utility and access easement, in addition to having frontage on Adams Alley. <br />December 2025 Findings & Decision: Action Jackson (MHT 25-35) Page 12 of 14 <br />
