The subject tax lot is a flag lot with 30’ of frontage on Airport Road, The Eugene <br />Development Code requires a minimum width of 20’ for the driveway and 7’ of L-2 landscaping <br />along the west side of the driveway to provide screening to the property to the west. There is an <br />existing 10’ wide public utility easement along the west side of the subject property and per EC <br />9.6500, no trees are allowed to be planted in a public utility easement. Since there is only 30’ of <br />frontage, there is not enough room to move the driveway and landscape area east and keep <br />everything on the same property. The L-2 landscape standard requires one canopy tree per 30 <br />linear feet as measured along the lot line. Since trees are not allowed in the public utility <br />easement and the proposed landscape area cannot be moved out of the public utility easement, <br />an Adjustment Review of the canopy tree requirement to the L-2 landscape standards is <br />requested. <br />9.8030 Adjustment Review - Approval Criteria. The planning director shall approve, <br />conditionally approve, or deny an adjustment review application. Approval or conditional <br />approval shall be based on compliance with the following applicable criteria: <br /> (3)(c)Low Screen Landscape Standard (L-2). The standards of EC 9.6210(2) may be adjusted <br />if the proposal achieves at least one of the following: <br /> 1. A landscape treatment that uses a combination of distance and low-level screening <br />(minimum 30 inches, maximum of 42 inches) to separate uses or development and the <br />screening is adequate to soften the impact of the use or development. <br />Response: There is an existing 6’ high screen fence along the entire length of the <br />proposed landscape area. The planting plan also calls out for 20 - Otto Luyken Laural <br />and 32 – Chelsea bonnet rockrose along the west property line which would satisfy the <br />low-level screening (minimum 30 inches, maximum 42 inches.) The existing and <br />proposed screening will soften the impact of the proposed use acceptably.
