Recitals: <br /> <br />1.1. LA Bola, LLC, an Oregon Limited Liability Company, GRANTEE , as described as follows: <br />Lots 35 through 56, and Lot 96 of WILLOW RIDGE as platted and recorded __________ ___, 20__ in Lane <br />County Oregon Plat Records and assigned Reception Number 20___-___________ in Lane County Oregon <br />Deed Records <br /> <br />1.3. This easement is not personal or in gross but is to be appurtenant to each and every portion of the <br />GRANTEE described in 1.2 above. <br /> <br />1.4. Easement Provisions: The terms of the easement are as follows: <br />3.1.1 Purpose <br />The easement is for slope construction and maintenance as may be needed to serve the GRANTEE <br />property. <br />3.2 Use of the Burdened Property <br />The GRANTOR property is the burdened property, and the owners of said property shall have the right to <br />use their property, including the area described in the easement, for any purpose so long as the owner or <br />occupiers do not interfere with the use if the easement as granted by this instrument. <br />3.3 Private Grant <br />The easement created by this instrument does not constitute a dedication or grant for public use, unless <br />requested at a later time by a public agency to dedicate the easement as public. <br />3.4 Taxes <br />The GRANTOR shall pay the real property taxes on that portion of the easement strip lying within the <br />GRANTOR property <br />3.5 Maintenance and Repairs <br />The slope shall be maintained in a condition. The cost of any maintenance or repairs of the area within the <br />easement shall be the responsibility of the GRANTEE property. Repair or maintenance required due to <br />the actions of an owner or agent of the GRANTOR property shall be the sole responsibility of the <br />GRANTOR property. <br />4. Successor’s in Interest, Recordation: <br />The provisions of this instrument touch, concern and relate to the use of the properties described in the Recitals <br />above, and are intended to be covenants and restrictions running with the land. This document shall therefore be <br />recorded in Lane County Oregon Deeds and Records, Lane County, Oregon. All provisions of this instrument, <br />including the benefits and burdens, are binding on and inure to their heirs, successors, assigns, transferees and <br />personal representatives of all parties who own the properties described in the Recitals above. <br /> <br /> <br /> <br /> <br />
