Page 2 of 5 <br />9.8193 Middle Housing Land Division, Tentative Plan Application Requirements <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific <br />requirements apply to middle housing land division tentative plan applications: <br />(1) The tentative plan included in the middle housing land division application must be <br />prepared by an Oregon licensed land surveyor. <br />The tentative plan included in this application has been prepared by Renee Clough, <br />PLS, PE, AICP. <br />(2) The application must include a preliminary title report. <br />This application includes a title report. <br />(3) The application must identify all contiguous property under the same ownership as <br />the property to be divided. <br />The applicant (Estate of Robert E. Scott) does not own any contiguous property. <br />(4) The application must be signed by the owner of the property to be divided. <br />The applicant (Estate of Robert E. Scott) has signed the application. <br />(5) The property to be divided must be a legal lot. <br />On February 2, 1946 (notarization date) Royal and Virginia Gick sold the land in this <br />partition via the Warranty Deed recorded in Book 310 on Pages 513-514. On February <br />18, 1947 Royal and Virginia Gick notarized Westwood Addition which recorded in Book <br />13 on Page 9. Also on February 18, 1947, Royal and Virginia Gick notarized Fairfield <br />Subdivision of Westwood which recorded in Book 13 on Page 10. The 1946 deed is <br />inside the boundary description of both plats and is depicted on both plats as “A”. <br />However, since the sale occurred prior to platting, the lands of this partition are not a <br />lot in either subdivision. The land in this partition is a legal lot due to being first <br />described before April 2, 1962 and having not changed configuration after April 2, <br />1962. <br />9.8194 Middle Housing Land Division, Tentative Plan Approval Criteria <br />The planning director shall approve, conditionally approve, or deny the middle housing <br />land division tentative plan application based on compliance with the following criteria: <br />(1) If the property to be divided is not yet developed with middle housing: <br />Per EC 9.8192(3)(b) this criterion is not applicable. <br />(2) If the property to be divided is developed with middle housing: <br />(a) The middle housing complies with EC 9.5550; or <br />(b) The certificate of occupancy for the middle housing was issued before June 30, <br />2022, and the middle housing complied with applicable land use requirements at <br />the time the certificate of occupancy was issued. <br />Per Subsection b, an RLID report is included in this application to show that the rear <br />dwelling has a separate address (Unit 1) from the front dwelling, both dwellings were <br />constructed prior to June 30, 2022 and are recognized as discrete dwellings by the <br />Lane County Assessor’s Office.
