<br />July 2025 Findings & Decision of the Planning Director Page 2 of 10 <br />Headwaters Trail Electric Upgrade (SDR 25-1) <br />Specifically, the project is within the Conservation Area and resource area of Upland Resource <br />E37-J and Riparian resource E30-D. While the project area is quite large, the scale of impact <br />within conservation areas is limited to approximately 1,500 square feet. Specific details <br />regarding the impact area for each resource are included in the applicant’s narrative. The <br />project also includes replacement of a pole adjacent to the bark-chip path along amazon creek. <br />In accordance with Eugene Code Sections (EC) 9.4930(3)(d) and 9.4930(3)(e), the maintenance <br />and repair of existing utility infrastructure (i.e. pole replacement) and new underground utility <br />lines are permitted within the conservation areas of protected resources, subject to review and <br />approval of a Standards Review application. <br />Additional details of the proposal are included in the applicant’s written statement , on <br />proposed site plans and in other supporting documentation, all of which are included as part of <br />the public record and located in the application file for reference. <br /> <br />Procedure, Public Notice, and Agency Referrals <br /> <br />Application <br />Timeline <br />Application Submitted April 24, 2025 <br />Application Complete June 4, 2025 <br />Public Notice June 13, 2025 <br /> <br />Public notice of the subject application was mailed in accordance with EC 9.7210. The Planning <br />Division received one response to the public notice, noting support for the project, but <br />requesting a correction on spelling and attributes to the Noble Family, whose gift to the public <br />now serves as an enduring natural resource and community benefit. <br /> <br />The Planning Division also provided information concerning the application to other <br />appropriate City departments, and neighborhood services. Any referrals received may be <br />discussed and summarized in the evaluation below and are incorporated herein by reference. A <br />copy of any referrals and public comments are included in the application file for reference. <br /> <br />Evaluation <br />This Standards Review application is subject to the Type II land use application procedures, <br />which are primarily addressed at EC 9.7200-9.7230. In accordance with the Standards Review <br />process beginning at EC 9.8460, the Planning Director shall approve, conditi onally approve, or <br />deny this application. The Planning Director’s decision is based on the following evaluation of <br />the proposal in the context of determining the uses subject to Standards Review at EC <br />9.4930(3) and compliance with the applicable approval criteria and related standards listed at <br />EC 9.4980 /WR Water Resources Conservation Overlay Zone - Development Standards. <br /> <br />The uses subject to Standards Review for this project, and the applicable standards and criteria <br />are provided below (in bolded text), including findings addressing compliance with each. <br />
