<br /> March 10, 2025 Meeting – Item 6 <br />EUGENE CITY COUNCIL <br />AGENDA ITEM SUMMARY <br /> <br /> Action: An Ordinance Concerning Stormwater Management; Amending Sections 9.6791, 9.6792, 9.6793, and 9.8030 of the Eugene Code, 1971; and Providing an Effective Date. <br /> Meeting Date: March 10, 2025 Agenda Item Number: 6 Department: Public Works Staff Contact: Doug Singer <br />www.eugene-or.gov Contact Telephone Number: 541-682-8460 <br /> <br />ISSUE STATEMENT This item is a recommendation to the City Council to adopt an ordinance amending sections 9.6791, 9.6792, 9.6793, and 9.8030 per requirements set forth in the City’s 2021 National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System Discharge Permit. The ordinance included as Attachment A has been revised to address concerns raised in the February 18, 2025 Public Hearing. <br />BACKGROUND At the January 27, 2025, City Council work session, staff presented the history of Eugene’s Stormwater Development Standards (stormwater standards), why the amendments are being proposed, and the proposed code amendments. The proposed land use code amendments to the stormwater standards are being made to comply with the City's 2021 NPDES Permit and the federal Clean Water Act. Eugene’s stormwater standards implement the NPDES permit requirements and regulate when and to what extent stormwater runoff from development shall be managed for flood control, flow control, and water quality prior to the stormwater runoff entering Eugene’s streams and rivers. Eugene’s stormwater standards have been in place since 2006, were updated in 2014, and are now proposed to be updated in 2025. The stormwater standards are an important element of the City’s multi-faceted stormwater program aimed at protecting and improving the water quality of Eugene’s streams and rivers, including Amazon Creek and the Willamette River. The City Council is being presented with an ordinance to amend the Eugene Code (EC) Chapter 9 stormwater development standards, which apply to land use applications and development (building) permits. At the February 18, 2025, City Council public hearing, Dane Butler, representing the Western Oregon Builders Association (WOBA) and Butler Homes, provided public testimony. Mr. Butler stated that WOBA’s main focus is to make sure that prior city approvals can be relied upon. In summary, Mr. Butler’s testimony on this ordinance asserts that, when the City’s approval of a land division or PUD specifically includes approval of a stormwater facility, that approval should be <br />CC Agenda Page 524
