(2) Except as provided in (4), all public improvements to public ways shall include stormwater <br />management facilities that are selected, sited, designed and constructed in accordance with the <br />Stormwater Management Manual. If there is a conflict between the Stormwater Management <br />Manual and the Public Improvement Design Standards Manual, the Stormwater Management <br />Manual shall control. <br />(3) Flood control stormwater management shall be included in all public improvements to public <br />ways unless the public improvements will be served by a flood control facility that is a manmade <br />drainage system designed to accommodate stormwater runoff generated by the stormwater basin <br />area. Capacity of the flood control stormwater management facilities shall be sized in accordance <br />with the applicable flood control design storm. <br />(4) Stormwater quality and flow control stormwater management shall be included in all public <br />improvements to public ways with the following exemptions: <br />(a) Construction of less than 1,000 square feet of new or replaced impervious surface within <br />a 12-month period; <br />(b) Replacement of impervious surface area that does not expose more than 1,000 square <br />feet of soil (for the purposes of this subsection, "soil' means: the unconsolidated mineral or <br />organic material on the immediate surface of the Earth that serves as a natural medium for <br />the growth of land plants); <br />(c) Maintenance, repair and/or replacement activities on an existing impervious surface to <br />prevent its decline, lapse or cessation in use; <br />(d) Replacement of impervious surfaces for utility trenching; <br />(e) Construction of new or replacement access ramps including wings, landings and <br />sidewalk sections, and construction of new curbside sidewalks along an existing street; or <br />(f) Construction of new or replacement impervious surface that will be served by an existing <br />City -approved stormwater quality and/or flow control facility that was designed and sized to <br />manage the stormwater runoff from the proposed impervious surface. <br />(5) Consistent with the Stormwater Management Manual, the City Engineer may authorize <br />construction of stormwater facilities to serve the public way at a location outside of the public way. <br />Section 3. The City Recorder, at the request of, or with the consent of the City Attorney, is <br />authorized to administratively correct any reference errors contained herein, or in other provisions <br />of the Eugene Code, 1971, to the provisions added, amended or repealed herein. <br />Section 4. Notwithstanding Section 32 of the Eugene Charter 2002, this Ordinance shall <br />take effect on May 1, 2025. <br />Ordinance - Page 2 of 3 <br />
