This work session is informational only. A public hearing is scheduled for February 18, 2025. <br />BACKGROUND The proposed land use and public improvement code amendments to the stormwater standards are being made to comply with the City’s 2021 NPDES Permit and the federal Clean Water Act. The City of Eugene’s stormwater standards implement the NPDES permit requirements and regulate when and to what extent stormwater runoff from development shall be managed for flood control, flow control and water quality. Eugene’s stormwater standards have been in place since 2006, were updated in 2014 and are now proposed to be updated in 2025. The stormwater standards are an important element of the City’s multi-faceted stormwater program aimed at protecting and improving the water quality of Eugene’s streams and rivers, including Amazon Creek and the Willamette River. The City Council will be presented with two separate ordinances, one to amend the Eugene Code (EC) Chapter 9 stormwater standards, which apply to land use applications and development (building) permits, and another to amend EC Chapter 7 stormwater standards, which apply to public improvement construction. The City’s NPDES permit requires the City to have post-construction stormwater pollutant and runoff control standards that prioritize on-site retention and water quality treatment of stormwater runoff through a hierarchy requiring on-site infiltration facilities first, on-site extended filtration facilities second and off-site mitigation third. These standards apply to new development and redevelopment projects that create or replace 1,000 square feet or more of impervious surface, with some exemptions. The proposed land use and public improvement code amendments are intended to align the City’s stormwater standards with the 2021 NPDES permit which implements current Federal and State clean water requirements by prioritizing low impact development and green infrastructure approaches to stormwater management. Details regarding the stormwater quality hierarchy are included in Attachment C to this AIS.
