1 | P a g e <br /> <br />Background <br />This annexation application pertains to a parcel of land identified as Assessor’s Map & Tax Lot 17-04-11-12-00200, also <br />known as 3335 River Road (“subject property”). The subject property is 0.41-acres in size and located on the east side of <br />River Road, approximately 100 feet south of Terra Linda Avenue. It is within the City of Eugene’s Urban Growth Boundary <br />(UGB) and contiguous to the city limits as adjacent River Road is under the City of Eugene’s jurisdiction. Parent zoning is <br />Eugene R-1 with an Urbanizable Land (/UL) zone overlay. The Metro Plan Designation is Low Density Residential (LD). <br /> <br />For City staff review, this written narrative demonstrates how the proposal complies with the annexation approval criteria <br />contained in the Eugene Code (EC) section 9.7825 Annexation – Approval Criteria. Additionally addressed are the applicable <br />Metro Plan and Santa Clara Urban Plan policies. Eugene Code and Policy language are indicated herein by bold and/or italic <br />typeface; applicant responses indicated by plain type. <br />EC 9.7825 Annexation – Approval Criteria. <br />The city council shall approve, modify and approve, or deny a proposed annexation based on the application’s <br />consistency with the following: <br /> <br />1. The land proposed to be annexed is within the city’s urban growth boundary and is: <br /> <br />a. Contiguous to the city limits; or <br />b. Separated from the city only by a public right of way or a stream, bay, lake or other body of water. <br /> <br />Response: The subject property maintains frontage on River Road. This section of River Road has been annexed into the city <br />limits; therefore, the proposed annexation is contiguous to the city limits in compliance with EC 9.7825(1)(a) above. <br /> <br />2. The proposed annexation is consistent with applicable policies in the Metro Plan and in any applicable <br />refinement plans. <br /> <br />Response: The subject property is located inside the Metro Plan Boundary in the City of Eugene’s UGB. The proposed <br />annexation is consistent with Metro Plan policies as they encourage compact urban growth in an effort to achieve efficient use <br />of land and urban service provisions while maintaining the residential and mixed-use character of the area. <br /> <br />Parent zoning for Tax Lot 200 is Eugene R-1 and the Metro Plan Designation is Low-Density Residential. The /UL zone <br />overlay will automatically cease to apply upon approval of this proposal by the City Council and the resulting jurisdictional <br />zoning and land use designation will be in congruity. <br /> <br />The refinement plan applicable to the subject property proposed for annexation is the River Road Santa Clara Urban Facilities <br />Plan. Compliance with the River Road Santa Clara refinement plan is addressed below. <br /> <br />3. The proposed annexation will result in a boundary in which the minimum level of key urban facilities and <br />services, as defined in the Metro Plan, can be provided in an orderly, efficient, and timely manner. <br /> <br />Response: The proposed annexation complies with EC 9.8725(3) as proximity to key urban facilities and services allows for <br />the orderly, efficient, and timely provision of such amenities. Some utilities required to serve the subject property are located <br />within the River Road right-of-way as shown on the accompanying annexation site plan. <br /> <br />The following urban facilities and services are in place and readily available to the subject property proposed for annexation: <br /> <br />- Electric and water service is provided by EWEB.
