My clients <br />include commercial and industrial businesses preparing to build new or expanded facilities and residential <br />development companies. This letter primarily concerns the proposed applicability of the standards and <br />the potential effective date of the adopting ordinance. <br /> <br />Applicability <br /> <br />1. Don’t Move the Goal Post for City Approved Land Use Decisions <br /> <br />Currently, certain types of land use decisions such as a Tentative Subdivision, Tentative PUD or Site <br />Review require positive findings that the proposed development is consistent with Eugene stormwater <br />standards.1 A Final Subdivision Plat must demonstrate that “All conditions of tentative approval have <br />been met and the final plat substantially conforms with the provisions of the approved tentative plan”.2 A <br />Final PUD, must demonstrate that “The final PUD plan conforms with the approved tentative PUD plan <br />and all conditions attached thereto”.3 <br /> <br />Subdivisions, PUDs and Site Review decisions also require recording notice of the approved land use <br />decision to help ensure property owners are aware of applicable land use decisions.
