Design Elements, as noted previously, the Hearing's Official's decision did not rely on these in <br />approving the townhomes or the rowhouses, as they were issues to be addressed by the <br />development's architectural review committee, not the city. As such, staff does not believe that a <br />modification is required to change these elements. To the extent a modification is necessary for the <br />applicant to change these elements, staff concurs with the applicant's findings that these changes will <br />have negligible impacts on the physical appearance of the development, the use of the site or on <br />surrounding properties. <br />Based on the above findings, this criterion is met. <br />Decision: <br />Based upon the available information and findings set forth above, it is concluded that, as <br />conditioned, the proposed modification will conform to the applicable criteria referenced in EC <br />9.8370. Approval of the applicant's requested modification is hereby granted subject to the following <br />conditions of approval. <br />Conditions of Approval: <br />1. The modified final PUD plans shall show compliance with the landscape standards of EC <br />9.6210(3) High Screen Landscape Standard (L-3) along the northern property line of Lot B. <br />2. The modified final PUD plans and Exhibit A to the applicant's written statement received <br />August 13, 2012, shall be revised to show minimum front yard setback for the detached <br />homes at 4 feet. <br />Informational Items <br />The proposed utility plans and private improvements, including private easements and size of <br />pipe, are conceptual and will be subject to compliance with applicable standards when <br />reviewed with subsequent development permits. <br />With regards to the proposed 7' public utility easement, Public Works recommends the <br />applicant contact EWEB since the easement would be used to cover EWEB facilities and <br />appurtenances. <br />For more information on the item above, contact Deanna Smith, Public Works Engineering at 541- <br />682-5714. <br />Post Approval: <br />Pursuant to EC 9.7220(3), the Planning Director's decision regarding this Type II land use application is <br />effective on the 13th day after notice of this decision is mailed, unless appealed according to the <br />procedures in EC 9.7605.
