My client has current residential
projects in various stages of design, approval and development.

The proposed amendments as currently proposed are overly broad and can cause
confusion and unnecessary cost and delay to residential projects. The proposed amendments
should apply prospectively only, and not to previously developed subdivisions, PUDs and infill
development. In many cases, as with previously approved subdivisions, Site Reviews and
PUDs, such are attached with development agreements that contractually bind the developer
and the City to terms, including development consistent with the approved plans and
standards in effect at the time of approval. The City cannot unilaterally impose additional or
different stormwater standards in such cases, even with newly adopted local legislation.

Sincerely,

/s/Micheal M.
