1 of 10 Exhibit A to Ordinance No. XXXXX <br />Findings of Consistency <br />Exhibit A to Ordinance No. XXXXX <br /> <br />Adoption of Code Amendments: Eugene Code Section 9.8065 requires that the following <br />criteria be applied to a code amendment: <br /> <br />(1) The amendments are consistent with applicable statewide planning goals adopted by the <br />Land Conservation and Development Commission. <br /> <br />Goal 1 - Citizen Involvement. To develop a citizen involvement program that insures the <br />opportunity for citizens to be involved in all phases of the planning process. <br /> <br />The City has acknowledged procedures for adoption of legislative land use decisions, located in <br />Eugene Code (EC) 9.7050 and 9.7500 through 9.7560, that ensure the opportunity for citizens to be <br />involved in all phases of the legislative land use decision process and set out the requirements for <br />such involvement. The stormwater development standards code amendments do not amend the <br />City’s adopted citizen involvement program. The process for adoption of the stormwater <br />development standards is consistent with the City’s acknowledged procedures for legislative land <br />use decisions. <br /> <br />To ensure that information and status would be available, staff maintained a webpage that holds the <br />proposed amendments, adoption schedule, and instructions on how to provide feedback. A meeting <br />was held with the Western Oregon Builders Association with on August 8, 2024, with a <br />commitment to additional meetings for more discussion. <br /> <br />Notice of the proposed amendments will be published and public hearings held prior to adoption. <br />Specifically, Department of Land Conservation and Development notice, notice to interested parties, <br />and a public notice in the local newspaper will be published prior to the initial public hearing. <br />Consideration of the amendments will begin with a Eugene Planning Commission work session on <br />September 10, 2024, followed by a public hearing before the Planning Commission on September <br />24, 2024. The Eugene City Council will hold a public hearing on October 21, 2024, to consider <br />approval, modification, or denial of the proposed amendments and Planning Commission <br />recommendation. These processes provide opportunity for citizen involvement consistent with Goal <br />1. <br />The process for adopting the stormwater development standards amendments complies with Goal 1 <br />since it is consistent with, and will not change, the City’s existing and acknowledged citizen <br />involvement provisions. <br /> <br />Goal 2 - Land Use Planning. To establish a land use planning process and policy framework <br />as a basis for all decisions and actions related to use of land and to assure an adequate <br />factual basis for such decisions and actions. <br /> <br />The Eugene Land Use Code specifies the procedure and criteria that are used in considering <br />amendments to the code. The record shows that there is an adequate factual basis for the stormwater <br />development standards amendments.
