update the priority for stormwater management to be infiltration first, followed by extended filtration,
and finally off-site stormwater quality management.

Eugene’s Stormwater Development standards, located at Eugene Code (EC) 9.6791-9.6793, apply to
land use applications and development permits (e.g. building permits). While the Stormwater
Development Standards contain specific requirements, much of the more detailed implementation
measures for stormwater management are contained within the Stormwater Management Manual.
Updates to the Stormwater Management Manual are also planned to comply with the recent NPDES
permit requirements, but, as the Manual is adopted administratively, that process will happen
independently from these code amendments.

More information on Stormwater Development Standard and the proposed code amendments can be
found at:

City of Eugene Stormwater Program website:
https://www.eugene-or.gov/463/Stormwater

NPDES Permit website:
https://www.eugene-or.gov/476/NPDES-Municipal-Stormwater-Permit

Land Use Code Amendment Application Materials can be found at:
https://pdd.eugene-or.gov/LandUse/SearchApplicationDocuments?file=CA-24-0003

Summary of Proposed Amendments
Each section of the Stormwater Development Standards (EC 9.6791 through 9.6793), as well as
applicable Adjustment Review criteria (EC 9.8030(24)), includes a series of changes specifically
designed to update standards to comply with the requirements of the City’s updated NPDES permit or
provide improvements for clearer application of stormwater standards. The following is a summary of
each section and the proposed changes:

• EC 9.6791 Stormwater Flood Control As proposed, this Section would be amended to
standardize the reference to the Stormwater Management Manual and remove unneeded and
out of date code language. The current code limits the stormwater flood control flow rates to be
calculated using only one method (the Rational Method), though there are other accepted
engineering methods for calculating stormwater flow rates. The proposed amendment removes
the limitation to only use the Rational Method which will allows the use of other calculation
options that can be listed in Stormwater Management Manual. The current code includes a
statement regarding federal and state regulations for Underground Injection Control systems,
this statement is not needed to be a part of code. The amendment would remove this unneeded
language regarding federal and state regulations.

• EC 9.6792 Stormwater Quality
o EC 9.6792(2) Water Quality Applicability and Exceptions. As proposed, this subsection
would be amended to standardize the applicability and exception criteria to align with
the City’s NPDES permit. The NPDES permit requirements apply to all new development
