<br />Applicant’s 8/21/2024 Annotations on <br />Revised Proposed Conditions of Approval <br />Braewood Hills Third Addition PDT 24-1 and ST 24-3 <br />The following condi�ons of approval include the proposed revisions and newly recommended <br />condi�ons of approval from the revised Public Works referral comments (July 30, 2024) and the <br />remaining unrevised condi�ons of approval from the staff report (July 10, 2024). <br /> <br />The Applicant’s recommended disposi�on of the staff’s 7/31/2024 recommended condi�ons <br />is shown below. Recommended changes to the language are shown in Red. Recommended <br />dele�ons are shown in s�keout red. Ra�onale with reference to the record is also provided. <br /> <br />1. Prior to final PUD approval, the applicant shall submit updated applica�on materials <br />demonstra�ng that an excep�on is warranted for Randy Lane under EC 9.6815(2)(h). <br />Alterna�vely, the applicant may submit for an Adjustment Review under EC 9.6815(2)(i), <br />which requires a Type II land use applica�on and is subject to the approval criteria at EC <br />9.8030(29). <br />Delete. <br />Applicant’s second open record submital, discussion point 2, at page 14, accomplishes this in <br />this proceeding; therefore, a condi�on is not needed. Applicant has jus�fied an excep�on <br />under EC 9.6815(3)(g)2 by showing with the KFPP graphic in Exhibit F that the topography will <br />not allow a connec�ng road that meets the city’s 20% grade limita�on. This is the same <br />ra�onale the City accepted in Round I, as quoted from the Round I Staff Report. <br /> <br />2. Prior to final PUD approval, the applicant shall submit an updated site plan depic�ng <br />that por�on of Randy Lane now shown as a proposed private street on Sheet L2.0 of the <br />applicant’s site plans, as a public street instead. The revised site plan shall show that <br />por�on of Randy Land will be designed and constructed to City standards as a public <br />street in accordance with EC 9.6505(3)(a) and the Local Street Design Standards of the <br />Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeway and <br />Accessways, as well as the City’s Public Improvement Design Standards (PIDS) Manual. <br /> <br />Delete. <br /> <br />This condi�on results from Condi�on 1 changing the plan to connect Randy Lane from west to <br />east, thus requiring all of the connected Randy Lane to be a public street developed to public
