on a lot containing any part of the setback will know that they cannot disturb, remove vegetation or <br />trees, build on, or make other alterations to any portion of that area. Too often, restrictions like this <br />are only noted when a person purchases a lot, but not later when the home changes ownership. <br />TRAFFIC <br />Because the Clear & Objective standards do not clearly address traffic impacts, the developer is <br />attempting to sidestep any requirements that a Traffic Impact Analysis (TIA) be done. We are <br />reminding the Hearing Officer <br />and the City that this is the first application for a PUD under the new Middle Housing Codes and <br />will be setting precedent. We are arguing two main points: <br />1. 1) Traffic estimates (called Peak Hour Vehicle Trips) should be based on the HIGHEST <br />potential number of housing units, NOT the number of lots. This is the only way to ensure <br />that the road infrastructure is not overtaxed by the addition of middle housing on the <br />property. 2) EC 9.8670 States a Traffic Impact Analysis Review is required when one of the <br />conditions in subsections (1) – (4) of this section exist a. EC 9.8670(1) The development <br />will generate 100 or more vehicle trips during any peak hour… <br />2. b. EC 9.8670(2) The increased traffic resulting from the development will contribute to <br />traffic problems in the area based on current accident rates, traffic volumes or speeds <br />that warrant action under the city’s traffic calming program, … <br />3. We believe the failure to require a TIA would defeat the purpose of EC 9.8670 and <br />therefore needs to be remedied with a denial of the application or, at a minimum, a <br />condition. <br />Remind them that Blacktail has already qualified for traffic calming and is on the waiting list, and <br />that the entrance to the development is at the intersection of Blacktail and Randy. <br />Summary: The decision is going to set a precedent with the PUD and Middle Housing. Traffic <br />numbers should be based on the maximum number of potential units and not the minimum so that <br />traffic infrastructure is not over-taxed. Additionally, the development will contribute to traffic <br />problems in an area that already warrants action under the city’s traffic calming program. <br />Remind them that Blacktail has already qualified for traffic calming and is on the waiting list, and <br />that the entrance to the development is at the intersection of Blacktail and Randy. <br />Summary: The decision is going to set a precedent with the PUD and Middle Housing. We have many concerns with their plan (see notes below codes): <br />EC 9.6790(2) Requires developers to control and minimize flows from development in the <br />Headwater Areas using a variety of techniques to release water to downstream conveyance <br />systems at a slower rate and lower volume, thereby reducing the potential for further aggravation <br />of instream erosion problems. <br />EC 9.6790(3) Emphasize stormwater management facilities that incorporate vegetation as a key <br />element, and include design and construction requirements that ensure landscape plant survival <br />and overall stormwater facility functional success. <br />EC 9.6791 Stormwater Flood Control (1) Purpose. The purpose of EC 9.6791 is to protect life <br />and property from flood and drainage hazards by maintaining the capacity of the city’s stormwater <br />conveyance system through the establishment of flood control regulations for stormwater runoff. <br />EC 9.6793(3)(a) Stormwater Flow Control (Headwaters) Applications shall demonstrate, using
