Tentative Partition Plan for Mike Hagen – W. 25th Ave & Portland Alley <br />Page | 1 <br /> <br /> <br />Background <br /> <br />This proposal requests approval of a Type II Tentative Partition designed for Assessor’s Map & Tax Lot 18-03-06-41-04901 (“subject <br />property”). The subject property is approximately .20 acres in size and located on northeast corner of W.25th Ave and Portland Alley, <br />west of Portland Street. Zoning for the subject property is City of Eugene R-2, designated Medium-Density Residential on the Metro <br />Plan. There are existing residential duplex dwelling units on proposed Parcels 1 and 2; these dwelling units will remain. <br /> <br />The entirety of the subject property was validated as a legally established unit of land by the City of Eugene in 2024 by City planning <br />action file number LV23-001 and recorded in Lane County as Land Partition Plat Number (LPPN) 2024-P3177. With the intention of <br />dividing the existing structures onto their own parcels, the proposed partition will effectively replat the subject property from one legal <br />parcel into three new legal lots. No additional dwellings or improvements are proposed with this tentative partition plan. <br /> <br />For City staff review, this written statement demonstrates the proposal’s overall compliance with the requisite approval criteria <br />contained in Chapter 9 of the Eugene Code (EC) specifically EC 9.8210 – Partition, Tentative Plan Application Requirements and EC <br />9.8215 – Partition, Tentative Plan Approval Criteria – General. Eugene Code sections are indicated by bold and/or italic typeface; <br />applicant responses follow in plain typeface. <br /> <br />EC 9.8210 Partition, Tentative Plan Application Requirements <br /> <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements apply to partition tentative <br />plan applications: <br /> <br />(1) Applications are prepared by an Oregon licensed land surveyor and contain a preliminary title report. <br /> <br />Response: The Tentative Partition Plan was prepared by Rex Betz, PLS of EGR & Associates. A Status of Record Title (SORT) report <br />is included with the application submittal materials. See attached Cascade Title SORT report # CT-0341754. <br /> <br />(2) Applications include all contiguous property under the same ownership as the subject property, and are signed by the <br />owner of the property. <br /> <br />Response: There are no contiguous properties in common ownership. The owner has signed the application. <br /> <br />(3) The lot proposed to be divided in the partition application is a legal lot. <br /> <br /> EC 9.0500 – Legal Lot. A lot of record that has boundary lines that were established: <br /> <br /> (A) Through a partition or subdivision procedure, <br /> <br /> (B) By a deed that was signed before April 2, 1962, or <br /> <br /> (C) Through approval of an application to validate a unit of land consistent with ORS 92.176. <br /> <br />Response: The subject property is a legal lot per EC 9.0500 Legal Lot Definition, Subsection (C), above, based on City of Eugene <br />Planning Action File No. LV23-001, approved in April 2024 by the City and recorded on May 2, 2024 in Lane County as LPPN 2024- <br />P3177. This criterion is satisfied. Please see attached LPPN 2024-P3177. <br /> <br />(4) If the proposal includes housing, the written statement submitted with the partition application shall clearly state whether <br />the applicant is electing to use the discretionary approval criteria in EC 9.8215 Partition, Tentative Plan Approval Criteria – <br />General/Discretionary instead of the approval criteria found in EC 9.8220 Partition, Tentative Plan Approval Criteria – <br />Housing/Clear and Objective. <br /> <br />Response: No housing is proposed with this tentative partition plan; however, the applicant is electing to use the <br />‘General/Discretionary’ approval criteria contained in EC 9.8215. This written statement details the proposal’s compliance with <br />applicable criteria outlined in EC 9.8125. <br />
