Intervenor-Respondent’s Standing 2 <br />Intervenor-Respondent Al Johnson has standing to intervene in this 3 <br />appeal under ORS 197.830(2) because he appeared in writing before the 4 <br />local government in this matter. See Rec. 714-15 (Item 41), attached as 5 <br />Exhibit D. 6 <br />B. Standing of Other Parties 7 <br />Intervenor-Respondent accepts the standing of the Petitioner and 8 <br />Intervenor-Petitioners. 9 <br />II. STATEMENT OF THE CASE 10 <br />A. Nature of the Land Use Decision and Relief Sought 11 <br /> This appeal concerns City of Eugene Ordinance No. 20667 12 <br />(Middle Housing Code Amendments, MHCA). The MCHA ordinance was 13 <br />adopted by the Eugene City Council to bring Eugene into timely compliance 14 <br />with Oregon’s new Middle Housing statutes, 2019 Or Laws Chapter 639 (HB 15 <br />2001), codified at ORS 197.758. Petitioner and Petitioners-Intervenor seek a 16 <br />remand of Ordinance No. 20667. LUBA should deny their assignments of error 17 <br />and requests for relief and affirm the subject decision. 18
