_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />site are addressed in the findings of compliance with EC 9.8325(5)(k) which discuss a future <br />Standards Review approval for impacts to the stream where Randy Lane will cross the stream <br />and EC 9.8330 Site Alteration. <br /> <br />Referrals <br />The Planning Division also provided information concerning the application to appropriate City <br />departments, public agencies, the neighborhood group, and service providers. All referral <br />comments received by the Planning Division on this application are included in the application <br />file for reference, and some are attached to this staff report for ease of reference, including <br />certain detailed informational items related to future development and permitting. The <br />substance of any relevant referral comments is addressed in the context of applicable approval <br />criteria and standards in the following recommendation. <br /> <br />SECTION 1 - PLANNED UNIT DEVELOPMENT EVALUATION <br />In accordance with EC 9.7330, the Hearings Official is required to approve, approve with <br />conditions, or deny a Type III land use application. The decision must be based on, and be <br />accompanied by, findings that explain the criteria and standards considered relevant to the <br />decision. The Hearings Official’s decision must also state the facts relied upon in rendering the <br />decision and explain the justification for the decision based upon the criteria, standards, and <br />facts set forth. <br /> <br />To assist the Hearings Official in rendering a decision on the application, staff presents the <br />following Tentative PUD approval criteria (shown below in bold typeface), with findings related <br />to each, based on the evidence available as of the date of this staff report. Staff also provide a <br />recommendation to the Hearings Official following the staff evaluation, below. <br /> <br />EC 9.8325(1): The proposal complies with EC 9.5860 Transition Standards. <br /> <br />The Transition Standards only apply to new buildings and increases in the square footage of <br />livable floor area of certain existing buildings for multi-unit developments and assisted care, <br />boarding and rooming houses, campus living organizations, university or college dormitories, or <br />single room occupancy uses where they abut land zoned R-1, S-C/R-1, or S-RN/LDR. The <br />Transition Standards do not apply to the single-unit and middle housing developments <br />proposed in the subject applications within the R-1 zone. Staff notes that while the applicant <br />addressed these standards in the written narrative, they are not applicable to the proposed <br />development. <br /> <br />EC 9.8325(2): The proposed land uses and densities within the PUD are consistent <br />with the land use designation(s) shown on the comprehensive plan diagram, as <br />refined in any applicable refinement plan. <br /> <br />The subject property is designated Low Density Residential on the Metro Plan land use diagram, <br />which is consistent with the property’s existing R-1 zoning. <br />Page 7 of 87
