Conditions Still Binding Page 1 <br /> <br />Conditions Still Binding from <br />Braewood Hills, 3rd Addition PUD (PDF 03-1) <br /> <br />The public record for the last PUD enacted for Braewood Hills have requirements still binding on this <br />new proposal. The application, public testimony, hearings findings, director decision, PUD agreement, <br />and final plans for PDF-03-1 all encompass the parcel under consideration now. <br />The following excerpts pulled from Eugene Planning records clearly show that the intent of the PUD <br />from 2003 still applies: <br />1. Hearings Official Decision (11-7-2001) <br />One of the many findings from the public hearings required the establishment of conservation <br />zones and that they be clearly shown. <br />2. Planning Director Decision (05-01-2003) <br />The Planning Director affirmed the requirement for conservation zones, particularly addressing <br />the vegetation on the steepest properties. <br />3. Referral Cover Memo from planning director (5-7-2003) <br />The Planning Director maintains that conservation zones are to be enforced at all times, <br />including during construction. <br />4. Final PUD Approved Site Plan (6-25-03) <br />Conservation zones are clearly delineated on the northern end of the property and notes on the <br />plan disallow any buildings or utilities to be placed on these areas. <br />5. Site map TP-9 (6-25-03) <br />The utility plan re-affirms that utilities are not to be placed in conservation zones. <br />6. PUD Agreement (06-30-03) <br />Agreement between the developer and the city clearly states that all successors are bound to <br />the terms of this PUD, including 27 conditions to be included in the CD&Rs for each property. <br />7. Tree Preservation, Planning & Removal Plan, Declaration of Covenants (10-23-2003) <br />The covenants for all properties in this PUD state the requirement for conservation zones and <br />the purpose they serve. <br /> <br /> <br />Page 41 of 87
