_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />18. All future building permits for Lots 30 through 35 shall depict the Goal 5 resource and its <br />40-foot setback from top of bank and shall include site plans showing the location of <br />protective fencing subject to the applicable standards at EC 9.4920-9.4930. <br /> <br />Based on the above findings and condition, the applicable /WR overlay standards are met. <br /> <br />Residential Development Standards <br />The applicant’s proposal includes single-unit development on the proposed lots, with the <br />potential for one or more of the lots to be developed with middle housing. The review of <br />specific development plans is necessarily being deferred to building permits for each individual <br />lot since the applicant does not specify the exact design or type of dwelling units to be <br />developed. The applicable development standards for these allowed residential dwelling types <br />are not “explicitly addressed” in the Tentative PUD application as stated in this criterion, so the <br />review for compliance with specific standards such as building height, setbacks, lot coverage <br />and additional requirements for middle housing types must be deferred to future building <br />permits. To ensure a demonstration of compliance at the time of future building permits, the <br />following condition of approval is recommended: <br /> <br />19. The final PUD plans shall include the following note: “Compliance with all applicable <br />development standards, special use limitations, and other general development <br />standards for single-unit or middle housing residential dwelling types shall be <br />demonstrated at the time of future building permit on each individual lot.” <br /> <br />With this additional note required as a condition of approval, the applicable development <br />standards will be met. <br /> <br />EC 9.8325(6): The applicant has demonstrated that wastewater service, transportation <br />service, stormwater service, water service, and electrical service will be provided to <br />the site prior to the need for those facilities and services. Where the facility or service <br />is not already serving the site, this demonstration requires evidence of at least one of <br />the following: <br />(a) Prior written commitment of public funds by the appropriate public agencies. <br />(b) Prior acceptance by the appropriate public agency of a written commitment by <br />the applicant or other party to provide private services and facilities. <br />(c) A written commitment by the applicant or other party to provide for offsetting <br />all added public costs or early commitment of public funds made necessary by <br />development, submitted on a form acceptable to the city manager. <br /> <br />Public Works staff concurs that adequate public utilities and services, including wastewater and <br />stormwater service, are presently available to the site or will be constructed through the <br />Privately Engineered Public Improvement (PEPI), site development, and building permit <br />processes. Findings at EC 9.8325(5)(b) and (j), regarding public improvements and stormwater <br />respectively, are incorporated herein by reference as further evidence that these services will <br />be available to the site. Given these findings, and the conditions referenced at EC 9.6505 also <br />incorporated by reference, this criterion is met. <br />Page 24 of 87
